Zemesgrāmatu lietās atstāto nostiprinājuma lūgumu bez ievērības problemātika.

Abstract

Zemesgrāmata ieņem svarīgu lomu tiesu sistēmā un dažādu tiesību uz nekustamo īpašumu nostiprināšanā. Tā kā praksē zemesgrāmatās tiek veiktas tādas darbības, kas nav paredzētas likumā, tad bakalaura darba mērķis ir uzlabot zemesgrāmatu lietu izskatīšanas procesu un samazināt atteikumu skaitu. Šim nolūkam īpaša uzmanība darbā ir pievērsta lēmumu nostiprinājuma lūgumus atstāt bez ievērības un ievērot tikai pa daļai analīzei, norādot nostiprinājumu veikšanas procesa trūkumus un piedāvājot iespējamos risinājumus. Samazināt atteikumu skaitu palīdzētu nostiprinājuma lūdzēja informēšana par trūkumiem lūgumā, tāpēc, lai viņš tos varētu novērst, nepieciešams veikt grozījumus Zemesgrāmatu likumā, ieviešot lēmumu nostiprinājuma lūgumu atstāt bez virzības un nosakot papildus pienākumus darbiniekam, kas pieņem dokumentus.

The Land register takes an important part in the judicial system and in the corroboration of different rights. Since in practice such actions that are not set in law are performed in land registers, the goal of the thesis is to improve the examination process of land register cases and reduce the number of refusals. For this purpose, special attention in the thesis is devoted to the analysis of the decisions to disregard the requests for corroboration in full and in part, indicating the problems in the corroboration process and suggesting possible solutions. If the applicant for corroboration was informed about the shortcomings in the request before the final decision is taken, he/she would be able to eliminate them and it would reduce the number of refusals. Therefore, Land Register Law should be amended, implementing decision to leave the request for corroboration not proceeded with and setting additional responsibilities to the employee who recieves the documents.
