Abstract

Aizgādnība pār pilngadīgām personām. Darba Autore Arta Šmukste. Darbā sniegts aizgādnības raksturojums, analizēti ar institūtu saistītie jēdzieni, apkopoti viedokļi par problēmām un izvirzīti priekšlikumi par veicamajiem uzlabojumiem, ņemot vērā šobrīd aktīvi notiekošo rīcībspējas regulējuma izstrādi. Uzdevumi: 1. aplūkot aizgādnības jēdziena būtību; 2. analizēt tiesisko regulējumu; 3. pētīt aizgādnības institūtu Latvijā un iespējamās alternatīvas; 4. izdarīt secinājumus un priekšlikumus. Pētījumā secināts, ka pēc ilgstošām diskusijām, nav atrasts ideālais rīcībspējas ierobežošanas mehānisms. Aktīvā cilvēktiesību aizsardzības ietekmē, ierobežojumi personām ar garīga rakstura traucējumiem samazinās, tomēr traucējumu izplatība gan nē. Lai neciestu tiesisko darījumu stabilitāte, jānodrošina līdzsvarota interešu ievērošana.

Trusteeship over persons of legal age. Author:Arta Šmaukste These bachelor-theses provide explanation of trustee, analysed concept of terms connected to institution of trusteeship and established proposals for improvements as at the moment very actively being developed regulation of legal capacity. Tasks:1.Deal with the trusteeship term nature;2.Analyse legal regulation;3.Investigate the institution of trusteeship in Latvia and possible alternatives;4.Establish conclusions and bring forward proposals. The main conclusion of project is that even after long-term discussions the perfect mechanism for legal capacity restriction has not found. Restrictions for mentally handicapped persons being reduced in the result of active human rights protection however mental intrusion keeps expand. At the moment it is necessary to provide balanced interest protection to insure stability of legal operations
