Administratīvā akta obligātās sastāvdaļas

Abstract

Diplomdarba tēma ir „Administratīvā akta obligātās sastāvdaļas”. Diplomdarbs sastāv no četrām nodaļām. Pirmajā nodaļā tiek veikta analīze par administratīvā akta sastāvdaļām, nosakot un izvērtējot kritērijus, uz kuru pamata likumdevējs ir noteicis Administratīvā procesa likuma 67.pantā noteiktās administratīvā akta obligātās un fakultatīvās sastāvdaļas. Otrajā nodaļā tiek analizēta administratīvā akta nozīme, struktūra un skaidrojumu Latvijas tiesību sistēmā. Trešajā nodaļā tiek izpētītas Administratīvā procesa likuma 67.panta otrajā daļā iekļautās administratīvā akta obligātās sastāvdaļas. Galvenā darba pētījuma daļa tiek veltīta administratīvā akta sastāvdaļu analīzei, atsevišķi izdalot katru administratīvā akta sastāvdaļu.

The aim of the graduation paper “Compulsory components of administrative act” is to analyze a structure of the administrative act, to clarify the components of the administrative act as well as the specific problems met in practice issuing administrative acts, to identify criteria and reasons for defining the components of the administrative act as compulsory and optional taking into account other countries’ experience in this field, to analyze criteria for the legislator to determine the components of the administrative act as compulsory. Section 3 analyses in the Article 67 (second part) of the Administrative Procedure Law incorporated compulsory components of the administrative act with reference to a jurisprudence and decisions made by Riga City Council (see attached).
