Iekāpšanas atteikums Aviopasažieru regulā

Abstract

Bakalaura darba tēma ir „Iekāpšanas atteikuma jēdziens Eiropas Parlamenta un Padomes Regulā Nr. 261/2004”. Bakalaura darba mērķis ir izpētīt iekāpšanas atteikuma jēdziena saturu gan teorijā, gan praksē. Tiks veikta padziļināta prakses izpēte un iespējamo situāciju modelēšana, kā arī regulējuma problēmu identificēšana un to risināšana. Darbs sastāv no ievada, četrām iztirzājuma daļām un kopsavilkuma. Pirmajā nodaļā tiks apskatīta iekāpšanas atteikuma definīcija un tās trīs pamat sastāvdaļas. Otrajā nodaļā tiks rasti iekāpšanas atteikuma izņēmumi, pamatotie iekāpšanas atteikumi. Trešajā nodaļā autors pētīs brīvprātīgā jēdzienu teorijā un praksē. Ceturtajā nodaļā tiks apskatītas iekāpšanas atteikuma sekas, kompensācijas apjoms un pieteikšana. Darba izveidei autors pētīs kā starptautiskos, tā nacionālos tiesību aktus un tiesu praksi, kā arī zinātnieku un juristu rakstus un pētījumus. Bachelor’s thesis: „The concept of denied boarding in European Parliament and Council Regulation No.261/2004”. The aim of this work is to research the extent of denied boarding both theoretically and practically. Special attention will be shown to the practical side of denying boarding as well as modelling possible situations and identifying some of the problems in the overall regulation and trying to solve them. This Bachelors work consists of an introduction, four chapters and a conclusion. The first chapter will be dedicated to the analysis of the definition of denied boarding and its three main ingredients. The second chapter will look at different exemptions from denied boarding, that are based on passengers own fault. The third chapter will provide the meaning of and the methodical application of volunteering. And the final chapter will look at what happens after boarding has been denied, passengers rights, compensation amount and the process of applying to receive compensation.
