Adopcija un tās būtiskie aspekti

Abstract

Adopcija ir veids, kā persona ar valsts palīdzību veido ģimeni. Valstij ir jākontrolē adopcijas norise, tai skaitā, adoptētāja un adoptējamā savstarpējā piemērotība. Darbā tiek pētīts adopcijas regulējums likumos, kas bija spēkā pirms mūsu ēras, kā arī kādiem kritērijiem jāatbilst personai, lai tā varētu būt adoptētājs. Darbā pētīts, vai un kā nebināra persona var kļūt par adoptētāju. Darba izstrādes procesā secināts, ka adopcijā pāri visām interesēm prevalē bērna interešu aizsardzība un tiesību ievērošana, nevis adoptētāja tiesības adoptēt bērnu.

Adoption is a way a person forms a family through the state. The state shall monitor the conduct of the adoption, including the suitability of the adopter and the adoptee. The adoption framework in laws that predate our era, which criteria a person must meet in order to be an adopter, is being explored. It has been explored whether and how a non-binary person can become an adopter. The study concluded that the protection of the best interests of the child and respect for rights prevail over all interests in adoption rather than the right of the adopter to adopt the child.
