Anotācija
Darba mērķis ir aplūkot Satversmes iztulkošanas metodoloģiju un Satversmes
iztulkošanas funkcijas īstenošanu Latvijas konstitucionālajā iekārtā.
Autors darbā secinājis, ka Satversmes iztulkošanas metodoloģija sevī ietver gan
iztulkošanas, gan tālākveidošanas elementus, tos integrējot speciālos konstitūcijas
iztulkošanas paņēmienos.
Darbā sniegts Satversmes iztulkošanas paņēmienu piemērošanas raksturojums, kā
arī aplūkotas to piemērošanas iespējas un norādītas uz atsevišķām nepilnībām
piemērošanas praksē.
Darbā izmantots plašs juridiskās prakses materiālu un parlamenta stenogrammu
klāsts. Autors apkopojis nozīmīgākās konstitucionālo tiesību diskusijas, kā arī analizējis
nozīmīgākos Satversmes piemērošanas jautājumus parlamentārajā un tiesu praksē.
Abstract The aim of the paper is to examine the methodology for interpreting the Constitution (Satversme) and implementation of the Constitution interpretation function in the constitutional regime of Latvia. The author has drawn conclusions that the methodology for interpreting the Constitution includes the elements of both interpreting and further development, by integrating the elements in special methods for interpreting the constitution. The work provides with a description of application of the Constitution interpretation method, as well as considers its application possibilities, pinpointing certain shortcomings occurring in practice. A broad range of legal practice materials and parliamentary shorthand reports have been used in elaboration of the work. The author has analysed the most important matters of applying the Constitution in the parliamentary and court practice.
