Korespondences neaizskaramības ierobežojumu pieļaujamība starptautiskajās cilvēktiesībās

Abstract

Ņemot vērā apstākli, ka starptautiskā sabiedrībā valstis arvien vairāk atsaucas uz mērķi aizsargāt valsts un sabiedrisko drošību, kā rezultātā veic noteiktu indivīdu telefona sarunu noklausīšanos, tradicionālā un elektroniskā pasta pārbaudi un cita veida personu korespondences ierobežošanu, maģistra darba ietvaros tiks izpētīts korespondences neaizskaramības institūts starptautiskajās cilvēktiesībās. Pētījuma rezultātā autors noteiks leģitīmus kritērijus tiesību uz korespondences neaizskaramību ierobežošanai.

Taking into account that in international society states are continuously referring to the aim to protect the interests of national security and public safety, as a result telephone conversations are being intercepted, electronic and postal, as well as other type of correspondence is being interfered, in the present master’s thesis the meaning of the right to correspondence in international human rights law will be analyzed. Consequently, the author will establish legitimate criteria of permissibility of restrictions of the right to correspondence in international human rights law.
