Institūcijas, kas var vērsties Eiropas Savienības Tiesā pēc prejudiciālā nolēmuma

Abstract

Izvēlētā bakalaura darba tēma ir "institūcijas, kuras var lūgt prejudiciālo nolēmumu Eiropas Savienības Tiesai". Galvenā problēma ir tāda, ka nav skaidri noteikts, kuras institūcijas var vērsties ES Tiesā pēc prejudiciālā nolēmuma. Kaut arī ES Tiesa Dorsch Consult lietā ir nosaukusi kritērijus, kādus jāizpilda institūcijām, šie kritēriji nav strikti noteikti.ES Tiesas prakse liecina par to, ka ir iespējami izņēmumi no šiem institūcijas kritērijiem. Tas noved pie tā, ka nav skaidri noteikta institūcijas, kura var lūgt ES Tiesai prejudiciālo nolēmumu, definīcija. Šī darba mērķi ir dot šo institūcijas definīcju, kā arī dot ieteikumus, lai uzlabotu prejudiciālo nolēmumu procedūru attiecībā uz institūcijām, kuras var lūgt ES Tiesai prejudiciālos nolēmumus. Autors uzskata, ka ir sasniedzis izvirzītos mērķus.

Bachelors’ thesis is "institutions which may ask EU Court of Justice preliminary ruling".The main problem is that there are no certainly define which institutions may ask European Court of Justice preliminary rulings. Although EU Court of Justice in Dorsch Consult case declared the criteria, which institutions must fulfil to know if they can refer to EU Court of Justice for preliminary reference, the criteria is not strictly determined. Practice of EU Court of Justice proves that there can be a exception from these criteria. That is why there are no clear definition of institutions which may ask preliminary references to EU Court of Justice. In this thesis the author trys to give it. The goal of this thesis is to define institutions, whisch may ask preliminary references to the EU Court of Justice and to give some recomendations to improve the preliminary reference procedure regarding institutions which may ask preliminary references to the EU Court of Justice. The author think he has achieved thesis goals.
