Kandidāta vai pretendenta izslēgšana no publiskā iepirkuma: aktuālās problēmas

Abstract

Bakalaura darba tēma ir „Pretendenta izslēgšana no publiskā iepirkuma: aktuālās problēmas”. Darba mērķis ir izzināt jauno Publisko iepirkumu likuma izslēgšanas noteikumu regulējumu, kas stājās spēkā 2023. gada 1. janvārī, un atklāt iespējamās problēmas, kas var rasties praksē piemērojot izslēgšanas iemeslus, kā arī identificēt iespējamās regulējuma nepilnības. Lai sasniegtu darba mērķi, autors izpētīs publikācijas, interneta resursus, normatīvos aktus, kā arī aplūkos Eiropas Savienības tiesas praksi.

The topic of the bachelor’s thesis is „Exclusion of a tenderer from airakk procurement: current issues”. The aim of the thesis is to explore the new regulation of the exclusion rules of the Public Procurement Law, which entered into force on january 1st, 2023, and to identify potential problems that may arise from applying the grounds for exclusion in practice, as well as identify possible gaps in the regulation. In order to achieve the objective of the thesis, the author will explore publications, internet resources, external laws and regulations, as well as the case law of the European Union court of justice.
