Samierināšanas problemātika mediācijā un tās sociālais diskurss

Abstract

Maģistra darbs “Samierināšanas problemātika mediācijā un tās sociālais diskurss” sastāv no trim daļām. Pirmajā daļā tiek pētīti sabiedrība un tiesības. Mijiedarbība starp tiesības un sabiedrību notikusi vienmēr. Mūsdienu sociums, konfliktu risināšanas nolūkā, izvēlas kardinālas metodes – tiesu, tā kā ir pārliecināti, ka tikai tā var atrisināt strīdu. Rezultātā tiesas ir pārpildītas, lietas tiek risinātas gadiem ilgi, bet puses turpina naidoties. Realizēt taisnīgumu un likumu var arī ar citiem, mierīgākiem ceļiem, viens no tiem – mediācija, konflikta mierīga noregulēšana ar starpnieka palīdzību, kas nerisina jautājumu par lietas iznākumu, bet novirza pārrunu procesu tā, lai visus strīdus atrisinātu bez tiesas iejaukšanās. Otrajā daļā tiek apskatīti mediācijas pamati. Pastāv loti daudz principu, kas jāievēro, lai neparkāptu indivīda tiesības mediācijas procesā. Mediatora darbība tiek stingri regulēta, tomēr, vadot mediācijas procesu, ir jāizturas pilnīgi neitrāli, neieņemot nekādu personisku pozīciju attiecībā pret kādu no mediantiem. Trešajā daļā autore apraksta mediācijas problemātiku. Tajā ietilpst aptaujas analīze, priekšlikumi un risinājumi, kā arī tiek aprakstīti mediācijas trūkumi. Lai pilnīgāk izpētītu šo tematu, autore izmantoja salīdzīnašanas metodi, pētot mediāciju ASV un Eiropas Savienības dalībvalstīs. Tēma ir aktuāla, jo tiesas ir pārslogotas, tāpēc tiek meklēti ārpustiesas strīdu risināšanas ceļi, viens no ceļiem ir mediācija. Rezumējot pētījumus, nobeigumā autors ir izdarījis vairākus secinājumus. Pētījumā ir izmantoti normatīvie akti, literatūra un interneta resursi. Master Thesis "Conciliation and mediation problems and its social discourse" consists of three parts. The first part examines the society and the right. Interaction between law and society has always been. Modern society to solve conflicts chooses radical methods - court, as it is convinced that it is the only way to resolve the dispute. As a result, the court is overcrowded, litigations are dealt with over the years, but the parties continues to litigate. For realizing justice and the law there are also other, more tranquil routes, one of them - mediation, peaceful conflict resolution through an intermediary, who does not deal with the outcome, but directs negotiating process and resolve any dispute without court intervention. The second part deals with the basics of mediation. There are many principles to be followed in order not to violate individual rights in the mediation process. The mediator's activity is strictly regulated, however, guiding the mediation process must be treated as a completely neutral, mediator should not take a personal position with regard to any of the mediant. In the third part, the author describes the problems of mediation. It includes survey analysis, proposals and solutions, as well as describing the mediation disadvantages. In order to explore more fully this topic, the author used the method of comparing, exploring mediation in the US and the European Union Member States. The theme is topical because the courts are overloaded, so the governement is searching for the extra tracks, one of them is mediation. To summarize the research, at the end the author has done a number of conclusions. Author used in her research laws, literature and internet resources.
