Negatīvā atzīšanas prasība civilprocesā

Abstract

Bakalaura darbā “Negatīvā atzīšanas prasība civilprocesā” ir apskatīta negatīvās atzīšanas prasības būtība, attīstība laika gaitā no Senās Romas līdz mūsdienām, tās vieta Latvijas un Eiropas Savienībā kā normatīvajā regulējumā, tā tiesu praksē. Bakalaura darba mērķis ir noskaidrot, vai Civilprocesa likuma 1. pantā ietvaros personai ir iespējams celt negatīvo atzīšanas prasību, kādos avotos ir meklējams pamatojums līdzšinējai tiesu praksei saistībā ar šāda veida prasībām, un kā negatīvās atzīšanas prasības tiek vērtētas citu valstu normatīvajā regulējumā un tiesu praksē.

The Bachelor's thesis “Negative declaratory claims in civil proceedings” examines the nature of the negative recognition requirement, the development over time from Ancient Rome to the present day, its place in the Latvian and European Union both in normative regulation and in case law. The purpose of the Bachelor's work is to ascertain whether, within the scope of Section 1 of the Civil Procedure Law, it is possible for a person to bring a negative declaratorty claim, the sources of which are the basis for previous case-law in relation to such claims, and how the negative declaratory claims are assessed in the normative regulation and case-law of other States.
