Tiesas paziņojumi un tiesas dokumentu piegādāšana

Abstract

Maģistra darbs veltīts tiesas paziņojumu un tiesas dokumentu piegādes izpētei. Darbā aplūkoti pavēstu un citu tiesas dokumentu piegādes veidi un ar to saistītā problemātika praksē un likumdošanā, kā arī starptautiskā civilprocesuālā sadarbība šajā jautājumā un ar to saistītā problemātika. Autore darba izpētes gaitā secinājusi, ka ir nepieciešams izdarīt grozījumus vairākos Civilprocesa likuma pantos, lai tik svarīgs aspekts, kā personas tiesības tikt informētai par pret viņu uzsākto tiesas procesu nebūtu tikai formāla likuma normu izpildīšana no tiesas puses. Turklāt autore, pētot starptautisko civilprocesuālo sadarbību dokumentu izsniegšanā, mēģinājusi rast praktiskus ieteikumus starptautisko civilprocesuālo normu piemērošanā. Master's thesis devoted to statements by the Court and the court document delivery research. The thesis examines summons and other court document delivery related problems in practice and legislation, as well as the international cooperation in civil procedure on this and related problems. During the research author of the work concluded that it is necessary to amend several articles of the civil procedure act, that would ensure such an important aspect as person's right to be informed of their legal proceedings. In addition, exploring international cooperation on civil procedure of documents, the author attempted to find practical guidance in the application of international rules on civil procedure.
