Kaitējuma kompensācija noziedzīgā nodarījumā cietušajiem

Abstract

Noziedzīgos nodarījumos faktiski cietušās personas var saskarties ar savu tiesību nepārzināšanu, kas savukārt liedz tās pienācīgā kārtā izmantot un aizsargāt savas intereses, tajā skaitā pieteikt kaitējuma kompensāciju. Tādēļ darba mērķis ir izpētīt cietušās personas regulējumu un apzināties cietušā lomu kriminālprocesā, lai noskaidrotu subjektu loku, kurš ir tiesīgs pieteikties kaitējuma kompensācijas saņemšanai. Tāpat tiek noskaidrots kaitējuma kompensācijas saturs, subjektu loks uz kuriem gulstas kompensācijas maksāšanas pienākums un kā problēmjautājumu pētot tās apmēra noteikšanas kritērijus. Pētījuma rezultātā tiek piedāvāti arī daži Kriminālprocesa likuma grozījumi precīzākam terminu izmantojumam.

Persons who are actually victims of criminal offenses may face ignorance of their rights, which in turn prevents them from properly using and protecting their interests, including applying for compensation for damage. Therefore, the aim of the work is to study the regulation of the victim and to understand the role of the victim in the criminal process in order to find out the range of subjects who are entitled to apply for compensation for damage. Also clarified are the content of damage compensation, the circle of subjects on whom the obligation to pay compensation rests, and, as a problematic issue, the criteria for determining its amount. As a result of the study, some amendments to the Criminal Procedure Law are also proposed for a more accurate use of terms.
