Abstract
Maģistra darbā “Ad hoc tribunālu individuālās atbildības nodrošināšanai izveides priekšnoteikumi”, izmantojot gadījuma analīzi, tiek pētīti un analizēti līdz šim izveidotie ad hoc tribunāli, lai identificētu to izveidošanas priekšnoteikumus, kuri turpmākajā pētījumā tiek izmantoti dažādu Īpaša tribunāla agresijas noziegumam pret Ukrainu izveidošanas scenāriju analīzē un izveidošanas iespējamības konstatēšanā. Līdz ar to darba mērķis ir, izmantojot līdzšinējos ad hoc tribunālu precedentus, secināt, kādiem priekšnoteikumiem jāiestājas, lai tiktu izveidots kāds no Pamatgrupas īpašā tribunāla agresijas noziegumam pret Ukrainu izveidošanai ietvaros piedāvātajiem ad hoc tribunāla modeļiem. Maģistra darba teorētisko pamatu veido akadēmiskās diskusijas par atbildības, jo īpaši juridiskās atbildības, konceptu starptautiskajās attiecībās, kā arī individuālās atbildības mehānismu ģenēzi un politiskās gribas nozīmi to izveidošanā. Darbā secināts, ka priekšnoteikumi ad hoc tribunālu izveidošanai katrā gadījumā ir unikāli un nevar tikt universāli attiecināti uz visiem ad hoc tribunālu izveidošanas gadījumiem. Tos ietekmē tādi apstākļi kā laika periods, sasniedzamais mērķis, noziegumu īstenošanas situācijas un to raksturs, kā arī katra ad hoc tribunāla unikalitāte, t.i., tā formu raksturojošās pazīmes.
Master’s thesis “Prerequisites for establishing ad hoc tribunals for ensuring individual accountability” researches and analyses the existing ad hoc tribunals using case analysis to identify the prerequisites of their establishment, which are used further in the master’s thesis to analyse and determine the likelihood of various possible scenarios for the establishment of Special Tribunal for the Crime of Aggression against Ukraine. Therefore, the purpose of this work is to conclude using the precedents of the ad hoc tribunals, which prerequisites must be fulfilled in order to establish one of the Special tribunal’s models proposed within the Core Group for the establishment of the Special Tribunal for the Crime of Aggression against Ukraine. The theoretical foundation of the thesis is grounded in academic discussions on the concept of accountability, particularly legal accountability, within international relations. It also examines the evolution of individual accountability mechanisms and the importance of political will in their establishment. The research concludes that that the prerequisites for establishing ad hoc tribunals are unique to each case and cannot be universally applied. They are influenced by factors such as the time period, objectives, specific circumstances surrounding the crimes, the nature of the crimes, and the distinctive legal characteristics of each ad hoc tribunal.
