Ekonomiskās efektivitātes apsvērumi kā juridisks arguments

Abstract

Maģistra darba mērķis ir noskaidro, vai un kad ekonomiskās efektivitātes apsvērumi var tikt izmantoti juridiskajā argumentācijā. Lai to izdarītu, jautājums, pirmkārt, tiek analizēts teorētiskā aspektā. Otrkārt, tiek analizēta ekonomiskās efektivitātes apsvērumu izmantošana pamattiesību aizsardzībā Satversmes tiesas praksē.Autors nonāk pie secinājuma, ka kritizējami var būt divi Satversmes tiesas prakses aspekti – ekonomiskās krīzes kā tiesību institūta izmantošana, kā arī sociālo tiesību tvēruma pakārtošana valsts ekonomiskajām iespējām.

The purpose of the master’s thesis is to establish whether and under what circumstances considerations of economical efficiency may be used by judiciary in the legal argumentation. Firstly, the issue is observed from a theoretical aspect. Secondly, the author analyzes, how the considerations of economical efficiency are applied in case-law of the Constitutional Court of Latvia and, particularly, regarding protection of fundamental rights. The author comes to a conclusion, that two aspects of the case-law of the Constitutional Court of Latvia may be criticized – the application of economic crisis as a legal institution and subordination of the scope of social rights to available resources of the state.
