Abstract

Šis Islāma laulības tiesībām veltītais darbs sastāv no trim nodaļām. Pirmajā nodaļā ir veikts vispārējs Islāma tiesību apskats un secināts, ka tās ir iedarbīgas, jo balstās uz ticību un brīvu izvēli, kā arī pakļaujas piemērošanai laika garam. Otrā nodaļa ir veltīta laulības noslēgšanai un laulāto tiesībām un pienākumiem laulības ietvaros, kā galvenos problēmjautājumus apskatot daudzsievību, aizbildnības laulības noslēgšanai institūtu, kā arī pienākumu sievai paklausīt vīram un atbilstošos vīra morālos un materiālos pienākumus. Trešās nodaļas tēma ir laulības izbeigšanās. Tiek secināts, ka laulības šķiršanas procedūra nav sarežģīta un laulāto mantas šķirtība novērš strīdus par mantas dalīšanu. Laulības šķiršanas tiesību realizācija vīrietim ir vieglāka nekā sievietei, toties sieviete laulības šķiršanā materiālā ziņā parasti ir ieguvēja.

The topic of this diploma paper is the Islamic Matrimonial Law. Its first chapter is an introduction to the Islamic law. The conclusions made are that the law is effective, belief being its origin, and that it allows flexible adaptation to the changing world. The main issues discussed in the second chapter dealing with the conclusion of a marriage and its effects are poligamy, guardianship in marriage for legally capable women, possibility of a compulsory marriage and the obligation of the wife to obey her husband and his corresponding obligations to treat her kindly and provide her with maintenance. The third chapter deals with the dissolution of a marriage. The various procedures are comparatively simple and not lengthy. It can be more complicated for the wife to get a divorce, her position after the divorce is mostly profitable yet.
