Kopdzīves likuma ietekme uz ģimenes institūtu.

Abstract

Sabiedrības viedoklis Latvijā par kopdzīvi, kā ģimenes formu un nereģistrētu partnerattiecību tiesiskā regulējuma nepieciešamību ir krasi atšķirīgs. Tomēr, ņemot vērā augošo tendenci pāriem veidot ģimeni, nenoslēdzot laulību, kā arī viendzimuma pāru tiesību jautājumu aktualizēšanos, ir nepieciešams izprast kopdzīves tiesiskā regulējuma ietekmi uz vienu no valstī svarīgākajiem insitūtiem – ģimeni. Jau šobrīd izpratne par ģimenes formu daudzviet pasaulē, t.sk., Latvijā ir mainījusies, kā rezultātā, tradicionālā izpratne par ģimeni, kā juridiski nostiprinātu savienību starp vīrieti un sievieti, kā arī to pēcnācējiem vairs nav vienīgais sabiedrībā pieņemamais ģimenes attiecību modelis. Līdz ar Kopdzīves likuma pieņemšanu mainītos nereģistrētās partnerattiecībās dzīvojošo pāru tiesības un pienākumi, kas palielinātu indivīdu atbildību vienam pret otru vēl pirms laulības noslēgšanas. Bakalaura darba „Kopdzīves likuma ietekme uz ģimenes institūtu” mērķis ir noskaidrot ģimenes jēdziena būtību mūsdienu sabiedrībā, kā arī izprast kopdzīves, kā tiesiski regulētas ģimenes formas, ietekmi uz partnerattiecībām un tās nozīmīgākajiem tiesiskajiem aspektiem.

Public opinion in Latvia on cohabitation, as the need for family forms and the legal framework for unregistred partnerships, vary considerably. However, in the view of the growing tendency for couples to form a family without concluding marriage as well as the issues of same – sex couples, it is necessary to understand the impact of the cohabitation legal framework on one of the most important institutions in the country – the family. Today already, the understanding of the family as a legally established union between a man and a woman, as well their offspring, is no longer the only acceptable family relationship model in society. With the adoption of the cohabitation law, the rights and obligations of couples living in unregistered partnerships would change, which would increase the individual's responsibility towards each other even before the marriage. The purpose of the bachelor's thesis “The impact of cohabitation law on family institute” is to clarify the essence of the concept of family in modern society, as well as to understand the impact of cohabitation as legally regulated family forms on partnership and its most important legal aspects.
