Kolektīvā dominance oligopola tirgū

Abstract

Eiropas Savienības konkurences tiesībās jau pagājušā gadsimta vidū parādījās diskusijas par iespējamām problēmām, kas var rasties oligopola tirgū, ja tas ir labi pārredzams. Tomēr šo problēmjautājumu risināšana praksē izrādījās liels pārbaudījums tirgus īpatnību dēļ un pēdējos desmit gados kolektīvas dominances koncepta attīstība ir apstājusies, taču nepieciešamība pēc skaidras izpratnes par kolektīvā dominējošā stāvokļa un tā ļaunprātīgas izmantošanas konstatēšu nav mazinājusies. Līdz ar to autors darbā centīsies aplūkot būtiskākos aspektus, ar ko Eiropas Savienības Komisija un tiesas ir saskarušas, piemērojot kolektīvās dominances konceptu, jo īpaši gadījumos, kad starp oligopola dalībniekiem nepastāv ekonomiskās saites, bet gan tikai vienojošie faktori.

In the competition law of the European Union, discussions about the possible problems that can arise in an oligopoly market if it is highly transparent appeared as early as the mid-20th century. However, in practice, solving these issues turned out to be a significant challenge due to market peculiarities. In the last decade, the development of the concept of collective dominance has stalled, but the need for a clear understanding of collective dominance findings and its abuse has not diminished. Therefore, the author will analyze the most important aspects that the European Union Commission and courts have encountered while applying the concept of collective dominance, particularly in cases where there are no economic links between the members of an oligopoly but only connecting factors exist.
