Starptautiska tribunāla izveides aspekti Krievijas – Ukrainas kara kontekstā

Abstract

Reaģējot uz Krievijas iebrukumu Ukrainā, starptautiskajā sabiedrībā aktuāls ir jautājums par Krievijas amatpersonu saukšanu pie atbildības par pastrādātajiem starptautiskajiem noziegumiem. Ņemot vērā, ka pašlaik nepastāv tiesiska mehānisma atbildības realizēšanai pār Krievijas veikto agresijas noziegumu, kā potenciāla iespēja ir speciāla starptautiska tribunāla izveide. Darba ietvaros autore secina, ka Krievijas – Ukrainas kara kontekstā kā perspektīvākais būtu reģionāls risinājums: Eiropas Padomes vadošā loma starptautiska ad hoc tribunāla izveidē uz daudzpusēja līguma pamata. Tribunālu būtu iespējams arī veidot kā starptautisku ad hoc tribunālu ar Apvienoto Nāciju organizācijas Ģenerālajās asamblejas iniciētu līgumu starp ANO un Ukrainu, tomēr šāda tribunāla izveide būs atkarīga no Ģenerālās asamblejas balsojuma. Hibrīda tribunālu formāts nav ieteicams potenciālu konstitucionālu problēmu dēļ.

In response to Russia's invasion of Ukraine, the international community is now focused on holding Russian officials accountable for the international crimes they have committed. Given that there is currently no legal mechanism to enforce accountability for the crime of aggression committed by Russia, the creation of a special international tribunal is a potential option. In the context of the Russia-Ukraine war, the author concludes that the most promising option would be a regional solution: a leading role of the Council of Europe in the establishment of an ad hoc international tribunal based on a multilateral treaty. It would also be possible to establish the tribunal as an international ad hoc tribunal through a treaty between the UN and Ukraine, initiated by the UN General Assembly, but the establishment of such a tribunal would depend on a vote of the General Assembly. The hybrid tribunal format is not recommended because of potential constitutional problems.
