Ģimenes tiesiskās atzīšanas un aizsardzības īstenošana.

Abstract

Maģistra darbā „Ģimenes tiesiskās atzīšanas un aizsardzības īstenošana” tiek vērsta uzmanība uz ģimenes jēdzienu un tā interpretāciju, kas sabiedrībā nav viennozīmīga. Pētījuma mērķis ir pētīt un sniegt priekšlikumus attiecībā uz ģimenes tiesiskās aizsardzības un atzīšanas problemātiku. Darba uzdevumi ir izpētīt Satversmes 110.panta vēsturisko attīstību, ģimenes jēdziena nozīmi, izvērtēt Satversmes tiesas sprieduma lietā Nr. 2019-33-01 ietekmi uz Latvijas tiesību sistēmu, kā arī izpētīt partnerattiecību institūta un faktiskās kopdzīves nepieciešamību Latvijā, izpētot kā partnerattiecības tiek regulētas citās valstīs. Darba rezultātā tiek secināts, ka lai nodrošinātu pilnvērtīgu ģimenes aizsardzības un atzīšanas īstenošanu ir nepieciešams ieviest partnerattiecību institūtu, kā arī noteikt faktiskās kopdzīves modeli.

In the master's thesis „Family legal recognition and protection implementation” attention is drawn to the concept of the family and its interpretation, which is ambiguous in society. The aim of the research is to study and make proposals regarding the issues of family legal protection and recognition. The tasks of the work are to study the historical development of Article 110 of the Constitution of Latvia, the meaning of the concept of family, to evaluate the Judgment of the Constitutional Court No. 2019-33-01 impact on the Latvian legal system, as well as to study the need for a partnership institute and need for actual cohabitation in Latvia, studying how partnerships are regulated in other countries. As a result of the work, it is concluded that in order to ensure full implementation of family protection and recognition, it is necessary to introduce the institute of partnership, as well as to determine the model of actual cohabitation.
