PIESPIEDU IZPILDES PROBLEMĀTIKA IZPILDU LIETĀS PAR UZTURLĪDZEKĻU BĒRNA UZTURAM PARĀDA PIEDZIŅU

Abstract

Uzturlīdzekļu parādu piedziņa ir sensitīvs un skrupulozs piedziņas process, jo tas skar neaizsargātākos sabiedrības locekļus - bērnus. Uzturlīdzekļu parāda piedziņu Latvijas Republikā regulē Civilprocesa likums. Maģistra darbs sastāv no septiņām nodaļām, kurās apskatītas uzturlīdzekļu parāda piespiedu piedziņas process. Pirmajā nodaļā aprakstīts uzturlīdzekļu institūta saturs un būtība, uzturlīdzekļu maksāšanas pienākuma rašanās un uzturlīdzekļu parāda piespiedu piedziņas vispārīgais process. Darba nākamajās nodaļās izvērtēta uzturlīdzekļu parāda piespiedu piedziņas procesa efektivitāte, konkrēti apskatot piedziņas vēršanu uz parādnieka naudas līdzekļiem, ņemot vērā, ka tas ir viens no primārajiem uzturlīdzekļu parāda piedziņas veidiem. Darbā apskatīta piedziņas vēršana uz parādnieka darba samaksu un tai pielīdzinātiem maksājumiem, analizējot parādniekam saglabājamo naudas līdzekļu apmēru. Kā arī, ir vērtēta piedziņas vēršana uz parādnieka naudas līdzekļiem kredītiestādē, analizējot normu, kas regulē šo piedziņas veidu saturu. Darba pēdējā nodaļā apskatīta tiesu izpildītāja un Uzturlīdzekļu garantiju fonda administrācijas mijiedarbība uzturlīdzekļu parāda piedziņas procesā. Autors darbā ir izvērtējis normatīvos aktus, kuri regulē uzturlīdzekļu parāda piedziņas procesu, efektivitāti un savstarpējo mijiedarbību parādu piedziņas procesā.

Recovery of child support debts is a sensitive and scrupulous recovery process, since it concerns the most unprotected members of the society – children. Recovery of child support debts in the Republic of Latvia is regulated by the Civil Procedure Law. The Master’s Degree Thesis consists of seven chapters, describing the process of enforced recovery of child support debts. The first chapter describes the contents and essence of the child support institute, occurrence of the duty to pay the child support and the general process of enforced recovery of child support debts. In the next chapters of the thesis the author evaluates the efficiency of the process of enforced recovery of child support debts, specifically discussing the procedure of directing of recovery against debtor’s money, taking into account that it is one of the primary methods of recovery of child support debts. The author discusses directing of recovery against debtor’s salary and payments equivalent to it, analyzing the amount of money to be retained for the debtor. The author also discusses directing of recovery against money of the debtor in credit institutions, analyzing the norm, regulating the contents of these types of recovery. The last chapter of the thesis contains the description of the cooperation between a bailiff and the administration of the Maintenance Guarantee Fund in the process of recovery of child support debts. The author has evaluated in the thesis the regulatory enactments, which regulate the process of recovery of child support debts, its efficiency and interaction in the debt recovery process.
