Priekšnosacījumi tiesībām būvēt uz svešas zemes

Abstract

Latvijā spēkā esošā likumdošana, kas regulē nomu apbūves vajadzībām, nodrošina dalītā īpašuma veidošanos, kad zeme un uz tās uzceltās ēkas pieder dažādām personām. Tas rada apjukumu ne tikai ārvalstu investoriem un juristiem, bet arī vietējām valsts institūcijām un tiesām. Būtiskākie jautājumi, kas tiek analizēti bakalaura darbā - dalītā īpašuma institūta problēmas; nomas līguma kā priekšnoteikuma būvniecībai uz svešas zemes noslēgšana un izpilde; zemes nomu regulējošās likumdošanas nepilnības; mantojamās nomas institūta un apbūves tiesības institūta kā iespējamā risinājuma aplūkošana dalītā īpašuma problēmu novēršanai.

In Latvia existing legislation of leasehold for building on the land whose ownership belong to different person provides an opportunity to derive divided property, where land and building on it belong to different persons. It results in confusion not only to foreign investors or lawyers but also to local authorities and court. The relevant issues analyzed in the bachelor’s paper focus on problems of divided property institution, contraction and fulfillment of lease agreement as the necessary precondition of building on the land whose ownership belong to different person, incompleteness of legislation regarding building on the land whose ownership belong to different person, longterm lease institution and building lease institution as the possible solution to the problems arising from divided property.
