Abstract
Bakalaura darba „Starptautisko organizāciju noteikto sankciju pārkāpšana” mērķis ir izpētīt Krimināllikuma 84. pantā paredzēto noziedzīgo nodarījumu un tā kvalifikācijas problēmas. Mērķa sasniegšanai darba autors izvirza sekojošus uzdevumus:
1.izpētīt starptautisko organizāciju veidošanās vēsturi, tiesībsubjektības jautājumu, apskatīt atsevišķas starptautiskās organizācijas;
2.izpētīt normatīvos aktus, uz kuriem ir dota atsauce Krimināllikuma 84. pantā;
3.izpētīt noziedzīgā nodarījuma kvalifikācijas problēmas.
Problēmas būtība ir apstāklī, ka pastāv tiesiskā nenoteiktībā attiecībā uz Eiropas Drošības un sadarbības organizācijas spēju noteikt starptautiska rakstura sankcijas. Pētījuma rezultātā darba autors ierosina veikt grozījumus likumā „Par starptautisko organizāciju noteikto sankciju ieviešanu Latvijas Republikā”, lai novērstu tiesisko nenoteiktību starp normatīvajiem aktiem.
The purpose of the Bachelor thesis „Violation of Sanctions Imposed by International Organizations” is to analyze the criminal offence of the section 84 of the Criminal law as well as its qualification problems. To achieve the afore mentioned aim of the Bachelor thesis, author sets out following tasks: 1. analyze international organizations’ origins, matters relating legal personality, particular international organizations; 2. analyze legislative enactments connected with section 84 of the Criminal code; 3. analyze criminal offence qualification problems There is legal uncertainty regarding the question if Organization for Security and Co-operation in Europe is capable of imposing international sanctions. As a result of the research the author proposes an amendment to the law “On the implementation of sanctions imposed by international organizations in the Republic of Latvia” to preclude legal uncertainty among legislative enactments.
