Ar prostitūciju saistītie noziedzīgie nodarījumi

Abstract

Prostitūcija un ar to saistītie noziedzīgie nodarījumi ir vienmēr pastāvējuši gan Latvijas teritorijā, gan ārvalstīs. Daudzi autori atzīst, ka to nav iespējams pilnībā apkarot, jo tie pastāvēs neatkarībā no likumdošanas un izstrādātas prostitūcijas novēršanas sistēmas valstī, tāpēc autores darba mērķis ir detalizēti izpētīt gan prostitūcijas, gan ar to saistīto noziedzīgo nodarījumu jēdzienu un būtību, noziedzīgo nodarījumu sastāvus, kvalifikācijas problēmas, veikt ārvalstu regulējuma analīzi, kas ļaus secināt par to nepieciešamību pārņemt Latvijā. Darba uzdevums ir, apkopojot iegūto informāciju un tiesu praksi, konstatēt Latvijas spēkā esošā regulējuma problēmjautājumus un izstrādāt secinājumus, kas ļauj nošķirt un izprast ar prostitūciju saistītos noziedzīgos nodarījumusProstitution and the related offences exist in Latvia and abroad on a regular basis. Many authors acknowledge that this offence is almost impossible to overcome entirely as it continues to exist being irrespective of the state developed legislation and prevention systems. Therefore, the aim of the thesis is to analyse in depth the concept and essence of prostitution and the related offences, the problem of qualification, composition of offences and to review the foreign regulatory experience. This analysis will help to make conclusions regarding adopting foreign practices in Latvia. In order to achieve these goals, the author of the thesis explores and summarizes the legal considerations and case law on prostitution to identify the current problematic issues in the legislation of Latvia and draw conclusions on how to deal with prostitution-related offences.
