Anotācija latviešu valodā
Promocijas darba tēma ir „Bērnu pārrobežu prettiesiskās pārvietošanas vai
aizturēšanas civiltiesiskie aspekti: starptautisko, Eiropas un Latvijas nacionālo tiesību
dimensijā”.
Promocijas darbs fokusējas uz starptautisko, ES un nacionālo tiesību
instrumentu mijiedarbības un piemērošanas analīzi attiecībā uz bērnu pārrobežu
nolaupīšanas jautājumiem, meklējot un piedāvājot iespējamos risinājums tādiem
jautājumiem kā bērna parastās dzīvesvietas noteikšana, bērna prettiesiska aizvešana
vai aizturēšana un jautājumiem, kas attiecas uz bērna atgriešanu vai neatgriešanu un
nolēmuma par bērna atgriešanu izpildi.
Promocijas darba mērķis ir vēst padziļinātu uzmanību uz Hāgas konvencijas,
Briseles IIbis Regulas un Latvijas nacionālā regulējuma piemērošanu un piedāvāt
priekšlikumus šo tiesību aktu uzlabošanai.
Doktora darbs sastāv no 4 nodaļām, kuras vēl ir iedalītas atsevišķās
apakšnodaļās.
Doktora darbs izceļ, ka jautājums par bērna parastās dzīvesvietas noteikšanu,
bērna prettiesisku aizvešanu vai aizturēšanu un jautājums, kas attiecas uz bērna
neatgriešanas pamatiem, ir vieni no sarežģītākajiem jautājumiem Hāgas konvencijas
vienotā piemērošanā un interpretācijā. Ārvalstu tiesu prakse Hāgas konvencijas
piemērošanā un interpretācijā norāda uz to, ka vienas valsts tiesas atsevišķus Hāgas
konvencijas noteikumus piemēro paplašināti, savukārt citas valsts tiesas tos pašus
noteikumus interpretē šauri. Pie tam Hāgas konvencija atstāj vairākus jautājumus
nacionālā regulējuma ziņā vai tiesu praksei, kas arī valstu vidū atšķiras. Tāpēc vienota
Hāgas konvencijas piemērošana pēc tās 30 gadus darbības ir apšaubāma un tāpēc
nākotnē vēl ir daudz diskutējamu un regulējamu jautājumu kā attiecībā uz Hāgas
konvenciju, tā arī Briseles IIbis Regulu un Latvijas nacionālo regulējumu.
Annotation The title of Doctoral thesis is „The Civil Aspects of Cross – border Child Removal or Retention: in Dimension of International, European and Latvian National Law”. The Doctoral thesis focus on examination of interrelation and application of the international, European Union and national legal instruments in matters of international child abduction, seeking and proposing for solutions on such issues as determination of the habitual residence of a child and wrongful removal or retention of a child and on issues regarding return and non–return of a child and enforcement of decision on return of a child. The objective of the thesis is to draw deep attention on the application of the Hague Convention on the Civil Aspects of International Child Abduction, Brussels IIbis Regulation and Latvian national regulation and suggest ammendmes to those legal acts. The Doctoral thesis consists of 4 Sections and several chapters in each section. The Doctoral thesis emphasizes that the issues regarding determination of the habitual residence of a child, wrongfulness of removal or retention of a child and grounds for non–return of a child are among the most difficult problems in uniform application and interpretation of the provisions of the Hague convention. Foreign case law applying and interpreting the Hague convention reflects that certain provisions of the Hague convention are interpreted broadly, while the same provisions by other courts are given very narrow interpretation. Besides, the Hague convention leaves a lot of matters to be regulated by the national law or case law, which again differs between countries. Therefore uniform interpretation of the Hague convention after 30 years of its application is still questionable and there are still a lot of issues to be discussed and regulated in the future in Hague convention, Brusells IIbis Regulation and Latvian national regulation.
