Abstract
Konfiskācija bez notiesājoša sprieduma jau tā ir saistīta ar vairākiem problēmjautājumiem, tostarp nevainīguma prezumpcijas, tiesībām uz taisnīgu tiesu un īpašumu tiesību garantēšanu, taču vēl neskaidrāks ir jautājums par situācijām, kad mantas konfiskācija pirmstiesas kriminālprocesā tiek piemērota bez notiesājoša sprieduma, taču vēlāk pamatprocesā persona tiek attaisnota, procesa virzītājam pieņemot reabilitējošu nolēmumu. Bakalaura darba mērķis ir analizēt Kriminālprocesa likuma 59.nodaļas “Process par noziedzīgi iegūtu mantu” piemērošanu praksē un ar to saistītās problēmas, kā arī piedāvāt iespējamos risinājumus. Bakalaura darba izstrādes ietvaros autors konstatēja tiesiskā regulējuma nepilnības, tādēļ piedāvā priekšlikumus tā pilnveidošanai. Non-conviction-based confiscation is already fraught with a number of issues, including the presumption of innocence, the right to a fair trial and the guarantee of property rights, but even more ambiguous is the issue of situations when confiscation of criminally acquired property is applied without conviction in pre-trial criminal proceeding, but the person is later acquitted in the main proceeding, when the person in charge of the process makes an exonerated decision. The aim of the bachelor's thesis is to analyze the application of Chapter 59 of the Criminal Procedure Law " Proceedings Regarding Criminally Acquired Property" in practice and related problems, as well as to offer possible solutions. As part of the development of the bachelor's thesis, the author identified the shortcomings of the legal framework, therefore offers proposals for its improvement.
