Abstract
Darbā aplūkoti problēmjautājumi, kas rodas, ja Jūrmalas pilsētas dome
izmanto tās īpašumu privāto tiesību jomā. To cēlonis ir nepabeigtais
privatizācijas process, nepilnīgais tiesiskais regulējums pašvaldības
īpašuma iznomāšanā un nesakārtotā normatīvā bāze tādu modernu publisko
projektu finansēšanai kā privātā un publiskā partnerība.
Autors piedāvā veikt izmaiņas normatīvajos aktos, skaidro jau esošo
tiesību normu pareizu piemērošanu un izsaka savus priekšlikumus
sekmīgam privatizācijas procesa nobeigumam. Pēc autora domām, tiesiski
ir pierādāma nepieciešamība privatizēt P SIA „Jūrmalas namsaimnieks".
Darba autors ierosina ierobežot pašvaldības pirmpirkuma tiesību
izmantošanu uz nekustamo īpašumu, kuras tās jau reiz pašas ir
atsavinājušas vai nodevušas privatizācijai. Attiecīgi veicot
grozījumus likumā „Par pašvaldībām" . Tā kā pašvaldības īpašuma
iznomāšana nav caurspīdīga un līdzīgos gadījumos ir pieņemti dažādi
lēmumi, tad nepieciešams pašvaldības īpašuma īri regulēt ar speciālu
likumu.
Darba autors ir piedāvājis savu tiesiskā risinājuma modeli privātās un
publiskās partnerības ietvaros, vienai no aktuālākajām pašvaldības
problēmām – pašvaldības īres namu būvniecība. Sekmīgai šī projekta
realizācijai būtu jānosaka cits juridiskais status pilsētas
investīciju plānam, nosakot tā saistošo raksturu gadskārtējam
pilsētas budžetam.
Research is about how municipality of the city Jūrmala must administrate its property in context with private rights. Main problems create unfinished process of privatization and week regulation in property rent area of the municipality. Author suggests using modern administrative tools, like, public private partnership to achieve social aims. Author show necessity of privatization such enterprises like P SIA „Jūrmalas namsaimnieks" and P SIA „Bulduru slimnīca". Otherwise there is possibility to raise a clime in the court and recognize refusal of the privatization as illegal. Author suggests to restrict right of pre-emption of the municipality in the case if it want to use them buying property witch it has alienated in 12 year tern. There is also necessity to annul prohibition for municipality to alien land if the person who has the right of pre-emption in the case of privatization doesn't use that. Private and public partnership is a good way how to build rent houses for the needs of municipality in Jūrmala. The main difficulty realizing this partnership is plan of the investments which is not obligatory and so it is impossible to realize long term projects. Author agrees that there is necessity for common rent regulation for property of the municipality. In Jūrmala exists such rent contracts between municipality and persons where are different conditions of the rent in similar cases.
