Kriminālatbildība par noziedzīgi iegūtu līdzekļu legalizēšanu

Abstract

Noziedzīgi iegūtu līdzekļu legalizācija ir noziegums ar starptautisku raksturu un tā apkarošana ir ļoti nozīmīga visas pasaules mērogā, jo šī problēma būtiski ietekmē visu pasaules valstu tautsaimniecību. Cīņa pret noziedzīgi iegūtu līdzekļu legalizāciju ir pasaulē aktuāla jau divdesmit gadu. Katru gadu tiek legalizēti līdz 8 triljoniem ASV dolāru, kas ir 2-5% no visas pasaules kopprodukta. Tāpēc darba mērķis ir izpētīt sekojošus problēmu jautājumus cīņā pret noziedzīgi iegūtu līdzekļu legalizāciju Latvijā: 1. Nepilnības Krimināllikuma 195.panta regulējumā un tā atbilstību starptautiskajam regulējumam; 2. Teorētiķu un praktiķu vienotas izpratnes trūkumu par 195.panta interpretāciju un tiesas doto skaidrojumu par šā noziedzīgā nodarījuma sastāvu; 3. Krimināllikuma 195.panta un 314.panta konkurenci Kopsavilkumā autore dod priekšlikumus, kādus uzlabojumus vajadzētu veikt Latvijas normatīvajos aktosThe bachelor work is devoted of this criminal malfeasance complex questions analysis and solves given. There were researching the imperfections in the 195 article of the Criminal law regulation and conformity to the international regulation, unitary understanding absence from theorists and practicals about an interpretation of the 195.article, a rivalry between the 195.article of the Criminal law and the 314.article as well. Quantity of the bachelor work is 54 pages. It consists from 3 chapters, 1 supplement and 62 sources. The scientific exploratory methods are used in the work like: the method of analysis, the method of history, the method of comparing, the method of inductive, the method of deductive and the method of sociology.
