Anotācija
Starptautiskā komerciālā arbitrāža ir svarīgs, efektīvs, privāts un tradicionāls
strīda izšķiršanas mehānisms, tādēļ darba „Starptautiskās komerciālās arbitrāžas
tiesības” mērķis ir padziļināti izpētīt un konstatēt starptautisko arbitrāžas tiesību
juridisko dabu, tiesību nozares attīstības tendences, kā arī nacionālo un starptautisko
avotu mijiedarbību un piemērošanas kolīzijas, tomēr, tā kā starptautiskās arbitrāžas
tiesības ir ļoti plašas - tās aptver jautājumus, sākot no šķīrējtiesas līguma noslēgšanas,
strīda izskatīšanas līdz brīdim, kad šķīrējtiesas spriedums tiek atzīts un izpildīts valsts
tiesā – šajā darbā ir analizēti tikai arbitrāžas tiesību būtiskākie jautājumi, šo tiesību
tvērums, avoti, subjekti, priekšmets un šķīrējtiesas līgums.
Nepietiekamais, pretrunīgais un kritiski vērtējamais šķīrējtiesas institūta
regulējums Latvijas nacionālajās tiesībās, kas savukārt ietekmē starptautisko
arbitrāžas tiesību piemērošanas izpratni un praksi, bija noteicošais faktors promocijas
darba tēmas izvēlē. Tāpēc sākotnēji darbā tiek konstatēta definīciju „starptautisks”,
„komerciāls”, „arbitrāža” dažādība, kā arī sniegta atbilde, kādas ir tiesiskās sekas, ja
arbitrāža ir starptautiska un komerciāla, kādi privāti un starptautiski avoti un kādā
veidā šajā gadījumā piemērojami. Darbā tiek analizēts, kā mainās šķīrējtiesas līguma
forma, spēks un interpretācija starptautiskajās arbitrāžas tiesībās atkarībā no
piemērojamām tiesībām, kādas ir tā sekas pusēm un trešām personām (tostarp
publisko tiesību juridiskajām personām).
Darba nobeigumā ir izteikti priekšlikumi grozīt nacionālo procesuālo likumu
attiecībā uz šķīrējtiesām, lai tas atbilstu starptautiskiem standartiem un būtu
piemērojams arī starptautiska procesa gadījumā, kā arī sniegti ieteikumi, kā piemērot
starptautiskās arbitrāžas tiesības gan tiesu, gan šķīrējtiesu praksē.

Abstract Doctoral thesis “International Commercial Arbitration Law” deeply examines legal nature and development tendencies of the international arbitration law as well as interaction and conflicts between national and international arbitration laws and rules. However, the international commercial arbitration law is very broad (covering the questions as from conclusion of arbitration agreement to enforcement and execution of arbitration award) the thesis is limited to the main questions and problems regarding the scope of the international commercial arbitration law, its sources, subjects and the arbitration agreement. Incomplete, controversial and criticized regulation of arbitration in Latvia, which respectively influences understanding and praxis in applying international arbitration law, was the main reason for commencing this research. For example, there are more than 190 arbitration institutions in Latvia and all of them have jurisdiction to hear also international cases. The dissertation starts with discussion of the diversity of such terms as “arbitration”, “international”, “commercial” then indicates the legal effect on arbitration and applicable public and private law if arbitration is defined as international and commercial. The dissertation deeply studies the validity, form, interpretation and binding effect of arbitration agreement to parties and third parties (including public law legal persons) depending on change of applicable rules. Finally, there are suggested many changes in the Latvian Civil Procedure Law in order the law would comply with international standards and be suitable for applying in international commercial arbitration procedure as well as the thesis specifically suggest the tips how to apply international arbitration law in arbitration and the court.
