Anotācija
Promocijas darbs ir veltīts tiesnešu tiesību jēdziena analīzei, tā izpratnes attīstībai un tiesnešu
tiesību nozīmes izpētei Latvijas tiesību avotu doktrīnā. Autore pēta tiesnešu tiesības kā tiesību
normu kopumu, kas pastāv tiesību sistēmā, ko atrod tiesa un kuru avots ir judikatūra. Tiesnešu
tiesību juridiskais statuss ir tieši atkarīgs no judikatūras statusa tiesību sistēmā. Pētījuma
ietvaros autore izvērtē nepieciešamību izdalīt judikatūru atsevišėā tiesību avotu grupā, attiecīgi
diferencējot judikatūras un pārējo tiesību palīgavotu lomu un tuvinot to patstāvīgajiem tiesību
avotiem, kā arī strukturējot to iekšēji. Darbā veiktā analīze dod būtisku inovatīvu risinājumu
judikatūrā atrodamo tiesu izstrādāto atziĦu juridiskā kvalificēšanā, to tiesiskā statusa atzīšanā un
pastāvošā tiesību avotu iedalījuma pārvērtēšanā.

Annotation The research is dedicated to concept of judge-made law, its development and role within the Latvian legal theory of sources of the law. Author researches the judge-made law as a body of legal norms actually existing in legal system but being distinguished from the other legal norms sources of which are normative acts, legal principles and customary law. Legal status of the judge-made law directly depends on the placement of judicature within the legal system. In this paper author considers necessity to detach judicature from the secondary sources of the law and establish new group of sources quite close related with the independent primary sources of the law. A conclusion based upon the research result in fundamentally innovative legal qualification of nature of the norms of judge-made law and is also a ground for reconsideration of the existing understanding of division of sources of the law.
