Abstract

Autore teorētiski analizē legāta jēdzienu testamentārās mantošanas ietvaros un atspoguļo praktiska pētījuma rezultātus. Teorētiskā daļa apskata legāta nodibināšanas formu un spēkā esamību, tā iegūšanu un atraidīšanu, izpildi un zaudēšanu, novēlējuma robežas un aprobežojumus. Pētījums veikts aptaujas veidā ar mērķi noskaidrot, cik liela Latvijas iedzīvotāju daļa apzinās legāta nodrošinātās priekšrocības testamentārajā mantošanā. Apskatīts notāra neitralitātes jautājums attiecībā pret mantošanas procesā iesaistītajām pusēm. Pastāvot iespējai, ka legāta priekšmets ir nekustamais īpašums vai legātos novēlēts viss mantojums, risināta kreditoru un neatraidāmo mantinieku interešu aizsardzības problēma. Autore norāda uz vajadzību noteikt mantojuma sadales prioritāro secību un dod citus ieteikumus likumu normu uzlabošanai.

The author analyses the meaning of ‘legate’ in testamentary inheritance and reflects the results of a practical research. Theoretically, the form of establishment and validity of a legate, its obtaining and rejection, execution and loss, the boundaries and limits of a bequest are discussed. The research is carried out in the form of a poll with an aim establish the proportion of the inhabitants of Latvia aware of the advantages provided by legate in inheriting. Notary’s neutrality in relation to the parties involved in inheriting is discussed. The protection of the creditors’ and indeclinable inheritors’ interests is considered taking into consideration real estate as the item of a legate or all inheritance consisting of legates. The author stresses the need to set the order in the division of an inheritance by priorities and suggests other improvements of the laws.
