Bakalaura darbs „Linči sods no Tan līdz Cjin dinastijai” ir veltīts nežēlīgu sodu un linči izpētei, kuri ir saistīti ar tradicionālajiem Pieciem sodiem un Ķīnas vēsturē nozīmīgākajiem likumu kodeksiem.
Ķīnā soda likumiem vienmēr ir bijusi svarīga loma sabiedriskās kārtības uzturēšanā. Tēma ir svarīga, lai izprastu, kā Ķīnas sodu sistēma mainījās vēstures gaitā un kādi apstākļi ietekmēja Ķīnas valdību mainīt likumdošanu 20. gs. sākumā. Ķīnas tradicionālo sodu sistēmu un mūsdienu kriminālo tiesvedību nevar izpētīt katru atsevišķi, jo sodu prakse 20. gs. Ķīnā vienmēr atspoguļoja pagātnes priekšstatus un apziņu par to, kā modernās prakses ir attīstījušās vēstures gaitā.
Linči Ķīnas sodu vēsturē tiek uzskatīts par ne-ķīniešu izcelsmes visnežēlīgāko un bargāko soda veidu, ko piesprieda par visnopietnākajiem noziegumiem, kurus Ķīnas valdība uzskatīja par nepieņemamiem un netikumiskiem.
Darba pamatmērķi ir izanalizēt Piecus sodus, to attīstību un saistību ar dinastiju kodeksiem, un noskaidrot vai linči bija tikai nežēlīgs soda veids vai arī likumīgs sods ar taisnīguma priekšstatu.
Darbs sadalīts trijās daļās. Pirmā daļa veltīta nežēlīgiem sodiem Tan dinastijā, Piecu sodu un linči pirmsākumiem, attīstībai, filozofiskajām teorijām un lomai Ķīnas sodu sistēmā. Otrā daļa veltīta nežēlīgiem sodiem Sun dinastijā, sodu sistēmai, izmaiņām sodos un linči izmantošanai Sun dinastijā. Trešā daļa veltīta linči un tā izmantošanai vēlīnās imperiālās Ķīnas laikā.
Darbā vēl ir pielikums, kas ietver vienu tabulu, 5 attēlus, četru pantu oriģināltekstus no „Lielā Min kodeksa” un vienu 248. panta oriģināltekstu no Tan kodeksa. Darbā ir tulkots 248. pants no Tan kodeksa un četri Min kodeksa panti (277., 310., 337. un 338.). Bakalaura darbs ietver 68 lappaspušu lielu apjomu. The bachelor degree assignment “Lingchi punishment from Tang to Qing dynasty” is devoted to the study of cruel punishments and lingchi, which are closely related with the traditional Five punishments and most notable law codes in the course of Chinese history.
Penal laws have always played an important role in maintaining social order in China. The topic is to understand how the Chinese penal system has changed in the course of history and what kind of circumstances influenced the Chinese government to change its legislation in the beginning of the 20th century. It is impossible to study the Chinese traditional penal system and modern criminal justice separately because the penal practice in the 20th century China has always reflected past concepts and awareness of how modern practices had developed in the course of history.
In Chinese penal history lingchi is considered to be the most cruel and heavy form of penalty of non-Chinese origin, which was imposed for the most serious crimes which Chinese government considered improper and immoral.
The basic bachelor paper objectives are to analyze the Five punishments, those development and connection with the dynastic codes, and to inquire whether lingchi was simply a cruel form of penalty or was it a legal penalty with a sense of justice.
The degree assignment is divided into three parts. Part one is devoted to cruel punishments in the Tang dynasty, the beginnings of cruel punishments and lingchi, those development, philosophical theories and role in the Chinese penal system. Part two is devoted to cruel punishments in the Song dynasty, the penal system, changes in penalties and the use of lingchi in the Song dynasty. Part three is devoted to lingchi and its use in late imperial China.
The bachelor paper also has a appendix, which includes one tabele, 5 pictures, four originaltexts of paragraphs from the „Great Ming Code” and one originaltext of paragraph 248 from the Tan Code. The degree assignment includes translations of paragraph 248 from the Tang Code and four paragraphs from the Ming Code (277, 310, 337 and 338). The diploma work has 68 pages.
