Franču valodas juridisko terminu tulkošanas problemātika latviešu valodā

Abstract

Darbā tiek pētīta franču valodas juridisko terminu tulkošanas problemātika latviešu valodā. Par pētījuma lauku galvenokārt izvēlēta tiesu izpildītāja institūtu, tiesnešu amatu un tiesību nosaukumu atveide latviešu valodā. Darbā ir izvirzīts mērķis noskaidrot, kāda loma juridiskajā tulkošanā ir starpkultūru komunikācijai, apzināt juridisko terminu savdabību, izpētīt juridisko terminu tulkošanas problemātiku, aplūkot ekvivalences teorijas klasifikācijas principus juridisko terminu tulkošanas kontekstā. Balstoties uz Francijas un Latvijas tiesu sistēmas līdzībām vai atšķirībām, darba mērķis ir arī aplūkot terminu atveidi latviešu valodā, apkopot uz pētniecības lauku attiecināmo terminu glosāriju un analizēt franču valodas juridisko terminu atveidi latviešu valodā. Iegūtie rezultāti norāda, ka tulkiem ir jābūt starpkultūru komunikācijas vidutājiem un ka juridisko terminu tulkošanas problēmas rodas no atšķirīgām valodu un tieslietu sistēmām, to veidošanās, burtiskiem tulkojumiem, terminu atveides nevienlīdzības, konsekvences trūkuma, turēšanās pie oriģināla, kas dažreiz ir vēlams, terminu atšķirībām dažādos laikos, terminu daudznozīmības, franču – latviešu juridisko terminu vārdnīcas neesamības un ikdienas valodas vārdu kā juridisku terminu lietojuma.

In the research paper the problems of French legal terms’ interpretation into Latvian are being explored. The course paper is based on the legal institutions’, lawyer’s professions’ and law titles’ interpretation into Latvian. The purpose of this work is to find out what role legal translation has in the intercultural communication, what particularities legal terms have, as well as to explore the problems of interpretation of legal terms and to observe the principles of equivalence theory classification in the context of legal terms. Based on the similarities or differences of the Latvian and French legal systems, the aim of this paper is also to observe the reproduction of terms into Latvian, to make the glossary of legal terms and to analyze the reproduction of legal terms into Latvian. The results indicate that interpreters and translators have to be mediators in intercultural communication and that the problems of interpretation of legal terminology are caused by different language and legal systems, their formation, direct translations, inequality in interpretation of terms’ meaning, lack of consequence, sticking to the original, which is sometimes desirable, differences of terms in length of time, polisemy of terms, lack of French – Latvian legal terminology dictionary and usage of everyday words as legal terms.
