Starptautiskās tiesības raksturojošie izteiksmes līdzekļi

Abstract

Mūsdienu sabiedrībā liela nozīme ir vienlīdzībai. Par to Eiropas Savienībā gādā Cilvēktiesības, kuru pamatprincips ir anti-diskriminācija. Tā ir būtiska Eiropas Savienības likumdošanas sastāvdaļa, nodrošinot visiem Eiropas Savienības iedzīvotājiem vienādas tiesības un pienākumus, kā arī labvēlīgu dzīves vidi, neraugoties uz viņu izcelsmi, seksuālo orientāciju, dzimumu, vecumu u.tml. Eiropas Savienības Padome ir laidusi klajā vairākas anti-diskriminācijas Direktīvas. Šis bakalaura darbs veltīts Eiropas Savienības anti-diskriminācijas Direktīvās izmantotās valodas izpētei, jo tieši izmantotā valoda ir tā, kas Eiropas Savienības iedzīvotājiem liek ievērot un paklausīt Direktīvās iekļautajiem likumiem. Bakalaura darbā ietvertā pētījuma uzmanības centrā ir Direktīvās izmantotās valodas gramatiskās, leksiskās, kā arī diskursa īpatnības. Darba mērķis ir noskaidrot, kuras gramatiskās, leksiskās un diskursa īpatnības ir raksturīgas Eiropas Savienības anti-diskriminācijas likumdošanai, un kādas ir to funkcijas juridiskajā kontekstā. Lai to noskaidrotu, darba autors kā pētījuma metodi ir pielietojis diskursa analīzi. Veicot analīzi, autors ir nonācis pie vairākiem secinājumiem, kas apvienoti sadaļā „Conclusions”, kā arī tie atspoguļoti tēžu veidā sadaļā „Theses”. Galvenie autora atklājumi ietver to, ka anti-diskriminācijas Direktīvās, paralēlas teikuma konstrukcijas nodrošina plūstošu informācijas gaitu, bieži sastopamie garie teikumi netiek sadalīti vairākos īsākos teikumos, lai tajos pateiktais netiktu pārprasts vai nepareizi interpretēts, kā arī lai tiktu nodrošināta vienmērīga informācijas plūsma. Savukārt modālais darbības vārds shall juridiskajā kontekstā tiek lietots, lai dotu kategoriskas un tiešas pavēles. Equality in the modern society is very substantial. The field which is responsible for that inside the European Union is the Human Rights, the basic principle of which is anti-discrimination. It is an essential component of the European Union law as it provides equal rights and responsibilities as well as favourable living conditions for all inhabitants of the European Union irrespective of their ethnic origin, sexual orientation, gender, age etc. The Council of the European Union has published several anti-discrimination Directives. This Bachelor paper deals with the investigation of the language applied in the European Union Directives because exactly language makes the people of the European Union observe and obey the laws included in the Directives. The investigation of the paper focuses on the gram-matical, lexical as well as discourse principles underlying the language applied in the Direc-tives. The goal of the paper is to find out which lexical, grammatical and discourse principles have been used in the European Union anti-discrimination law, as well as to understand what function they accomplish in the legal discourse. To find it out, the author has made use of the discourse analysis as a research method. During the research the author has drawn several conclusions that are combined in the section “Conclusions” as well defined in the form of the-ses in the section “Theses”. The main findings of the author include such discoveries that in the Directives of the European Union parallel sentence constructions provide a smooth infor-mation flow, long, very frequently used long sentences are not divided into several shorter sentences so that they would not be misinterpreted and the idea would not be interrupted, but the modal verb shall in a legal context is used to give imperious and direct orders.
