Latviešu folklora – mantojuma ierašu tiesību avots

Abstract

Maģistra darbs “Latviešu folklora – mantojuma ierašu tiesību avots” daļēji aizpilda robu, kas juridiskās folkloras pētniecībā Latvijā veidojies kopš 20. gadsimta pirmās puses. Darbā folkloristikas, legālajā un vēstures diskursā pētīta tiesiskā doma, kas veidojusi latviešu mantošanas ieražas. Darba mērķis ir, analizējot latviešu klasiskās folkloras materiālu, salīdzinot to ar rakstītajiem vēstures un tiesību avotiem, ilustrējot ar citu tautu ieražu tiesībām, identificēt juridisko terminoloģiju un mantojuma tiesību principus, apzināt mantošanai pakļauto mantu, noskaidrot mantošanas tiesību adresātus, izzināt tiesiskās uzvedības modeļus un tiesiskos motīvus. Darba rezultātā tiek iegūta padziļināta izpratne par tiesību kultūru un mantošanas ieražām latviešu folkloras tiesiskajās tradīcijās.

The Master's thesis “Latvian Folklore as a Source of Common Heritage Law” partially fills the gap that has existed in the study of legal folklore in Latvia since the 1920s-1940s. In a discourse of folkloristics, legal science and history, the thesis studies the legal thought that has formed Latvian inheritance customs. The goal is to identify principles of legal terminology and inheritance rights, study property subject to inheritance, determine inheritance beneficiaries and determine models of legal behaviour and motives through an analysis of classic Latvian folklore material, written historical and legal sources and illustrations of the inheritance customs of other ethnic groups. The thesis has resulted in a deeper understanding of legal culture and inheritance customs in the legal traditions of Latvian folklore.
