Binomiālo frāžu veidi juridiskajos dokumentos

Abstract

Šajā Bakalaura darbā tiek izpētīts binomiālo frāžu pielietojums juridiskajos dokumentos. Ņemot vērā ka binomiālās frāzes tiek atzītas par neatņemamu un svarīgu juridiskās Angļu valodas aspektu, tuvāka šī temata izpēte tika pieņemta par cienīgu un aktuālu. Veiktā pētījuma teorētiskā daļa nodrošina teorētisko fonu attiecoties uz pētījuma jautājumiemun tēmām kā arī uz piemērotajām empīrisko metožu pētījumu analīzēm. Empīriskie pētījumi tika veikti ar primāro mērķi noskaidrot visus iespējamos binomiālo frāžu veidus balstoties uz to pielietojumu 50 dažādu žanru juridiskajos dokumentos. Šim nolūkam, komponentāla semantisko iezīmju analīze tika piemērota lai atbilstoši klasificētu binomus noteiktās semantiskās kategorijās. Piedevām, uzmanība tika veltīta arī uz binomu stilistikas īpašibām balstoties uz vārdu kārtību un frāžu gramatisko uzbūvi. Šī pētījuma sekundārais mērķis bija īstenot kvantitatīvu analīzi un veikt novērojumus pamatojoties uz identificēto binomiālo frāžu pielietojumu 5 žanru juridiskajos dokumentos: pilnvarās, testamentos, līgumos, aktos un tieslietās. Juridiskie dokumenti izpētes nolūkiem tika iegūti no vairākiem publiskā domēna tiešsaistes avotiem, kā arī no juridisko departamentu arhīviem. Rezultāti ataino un apstiprina piecu konkrētu binomiālo frāžu būtiskumu saskaņā uz noteiktiem semantiskiem aspektiem: sinonīmija, opozīcija, homosemija, komplementācija un hiponomija. Kvantitatīvo analīžu rezultāti papildus precizē kā atsevišķu juridisko žanru dokumenti biežāk atsaucās uz specifiskiem binomu veidiem. Turklāt, noteikti binomiālo frāžu veidi ar konkrētu vārdu secību, garumu un gramatisko struktūru pierādījās daudz būtiskāki atkarībā uz to pielitojumu un biežumu noteiktos juridisko dokumentu žanros.

The present research paper investigates the utilization of binomial phrases in legal documents. Given how binomial phrases are recognized as an integral and important aspect of legal English language, a closer examination of this topic was considered worthy and topical. The theoretical part of the paper provides a theoretical background to the research questions and subjects, and to the empirical methods of research analysis that were applied. Empirical research was undertaken with the primary purpose to identify all possible binomial expression types evident in a selection of 50 legal documents of various genres. For this purpose, componential analysis of semantic features was applied in order to properly classify binomials into semantic categories. In addition, the stylistic binomial properties of word order and grammatical make up of phrases was also taken into consideration. The secondary aim of this study was to conduct a quantitative analysis and make observations based on the frequency of identified binomial types in legal documents of 5 different genres: powers of attorney, wills, agreements, acts and court cases/pleadings. The legal documents under analysis were taken from a number of public domain online sources as well as legal department archives. The findings demonstrate and confirm the relevance of five specific binomial types classified according to their semantic aspects: synonymy, opposition, homosemy, complementation and hyponymy. Quantitative analysis of results further specifies how certain genres of legal documents relied on specific types of binomial phrases. Moreover, certain binomials with specific word order, length and grammatical structure proved to be more significant and frequent depending on their use in different legal genres.
