Nepilngadīgo personu likumpārkāpumu prevencija kā kriminālsoda mērķis

Abstract

Promocijas darba mērķis ir radīt prevencijas jēdziena teorētisko bāzi, kas sevī ietver nepilngadīgo likuma pārkāpumu prevencijas mērķi, mērķa grupas un prevencijas formas. Promocijas darbs fokusēts uz līdz šim maz pētīto noziedzīgo nodarījumu prevencijas fenomenu krimināltiesībās un tā realizāciju praksē. Noziedzīgo nodarījumu prevencija tiek analizēta nepilngadīgo personu tiesiskā statusa kontekstā, kas atšķiras no pilngadīgo personu statusa. Pētījuma gaitā tiek analizēti principi, uz kuriem balstīta noziedzīgo nodarījumu prevencija kopumā, prevencijas jēdziena attīstība, definēts prevencijas jēdziens un tā saturs, vienlaikus tiek pētītas metodes, formas un veidi, kādos tiek īstenota nepilngadīgo noziedzības prevencija tiesību normu piemērošanas praksē.

The objective of the thesis is to create the theoretical framework for prevention, which includes an objective of minor’s crime, also target groups and forms of prevention. These theses focus on examination of just a little explored research area within criminal justice: on phenomenon of youth crime prevention and its implementation in practice. Youth crime prevention is being analysed within the context of the legal status of the minor, which is different from adult person’s status in criminal justice. The study examines the principles underlying crime prevention in general, the development of the concept of prevention, defines the concept of prevention and its content, and at the same time explores the methods, forms and ways in which juvenile crime prevention is applied in practice.
