Pierādīšanas teorija un brīvie pierādījumi jeb pierādījumi ar procesuālu nozīmi kriminālprocesā

Promocijas darbs (disertācija) ir autora vairāku gadu patstāvīgi veiktu pētījumu apkopojums, kurus darba autors ir veicis juridiskajā zinātnē, krimināltiesībās, kriminālprocesā. Promocijas darbā (disertācijā) autors ir izpētījis un analizējis vairāku savstarpēji saistītu jautājumu kopumu, kuri ietilpst kriminālprocesuālās pierādīšanas teorijas vispārējā daļā.
Kā daļēji parāda promocijas darba nosaukums „Pierādīšanas teorija un brīvie pierādījumi jeb pierādījumi ar procesuālu nozīmi kriminālprocesā”,
tad kriminālprocesuālās pierādīšanas teorijas izpēte, kam šajā darbā formāli
veltīta visai liela daļa, nav autora pētījumu un šī promocijas darba pašmērķis
jeb galvenais uzdevums, bet kriminālprocesuālās pierādīšanas teorija kā tāda
un atsevišķi šīs teorijas jēdzieni un institūti darbā tiek apskatīti un pētīti ar
mērķi šīs izpētes rezultātā izpētīt un definēt atsevišķi nodalāmu Latvijas
kriminālprocesa zinātnei pilnīgi jaunu, iepriekš nepazītu jēdzienu un agrāk
nedefinētu kriminālprocesuālo pierādījumu grupu.
Darbā autors pamato savu viedokli procesuāli nozīmīgo pierādījumu
grupas un šādu pierādījumu procesa kā tādu pastāvēšanu, formulē
kriminālprocesam procesuāli nozīmīgas pierādījumu grupas pazīmes un
īpašības, dod ieskatu par gadījumiem, kad kriminālprocesā parādās un tiek
izmantoti šādi pierādījumi. Kā sava darba uzdevumu tā autors saskata
padziļināti izpētīt konkrēto tiesību teorijas jautājumu loku, dot savu ieguldījumu zināšanu papildināšanā par ar darba tēmu saistītiem
jautājumiem un iepazīstināt ar sava pētījuma rezultātiem un secinājumiem
Latvijas tiesību zinātniekus, juristus un studentus. Darba tālākais, nākotnes
mērķis ir pamatot nepieciešamību procesuāli nozīmīgo pierādījumu grupu ne
tikai atzīt un definēt kriminālprocesa tiesību teorijā, bet to nākotnē definēt
arī kriminālprocesa likumu normās. The present doctorate paper (dissertation) covers the author’s
independent, long-term research, performed in legal science, criminal law
and criminal procedure. The doctorate paper (dissertation) studies and
analyzes a totality of several interrelated issues that are included in the
general part on legal argumentation theory.
As it is partly revealed by the dissertation title “Legal
Argumentation Theory and Circumstantial evidence or Evidence of
Procedural Importance in the Criminal Procedure”, the profound study of
legal argumentation theory in the paper is not the general aim of author’s
research and the dissertation, but legal argumentation theory in itself and
several of its concepts and institutions in the paper are dealt with and
studied on purpose to investigate and define a separate group of
completely new concepts and previously undefined criminal procedural
evidence in the science of criminal procedure of Latvia.
In the present paper the author substantiates his point of view on
the existence of circumstantial evidence or evidence of procedural
importance in itself, formulates the features and qualities of evidence of
procedural importance in the criminal procedure, and gives an insight in
the cases of the emergence and usage of the mentioned evidence.
Author’s aim is to research in depth the theoretical basis of the concepts
under discussion, to contribute to the accumulation of knowledge on the
paper related issues, and to introduce the Latvian law scholars, lawyers
and students with the outcome and conclusions of the research. The future
aim of the study is to substantiate the necessity for the admission and
definition of evidence of procedural importance in the theory of the
criminal procedure law, and further on- to define clearly its role in the
legal provisions.
