Promocijas darba mērķis ir, pētot ES tiesību būtību, noskaidrot to attiecību ar dalībvalstu tiesībām optimālāko modeli; identificēt jomas, kurās kolīzijas starp ES un dalībvalstu tiesībām ir iespējamas galvenokārt, kā arī šo kolīziju risināšanas pamatprincipus un mehānismus.
Darbs sastāv no trīs nodaļām. Pirmajā nodaļa ir sniegts tiesību normu kolīzijas jēdziena skaidrojums, tai skaitā, vēsturiskā plāksnē. Pirmajā nodaļā autore arī izdala vairākus tiesību normu kolīziju veidus un parāda dažādus to risināšanas metodes. Attiecībā uz kolīziju risināšanu vienas tiesību sistēmas ietvaros autore secina, ka pirmo kolīzijas risināšanas soli gan valsts, gan starptautisko tiesību sistēmā veido atbilstības pārbaude tiesību sistēmas pamatnormai. Savukārt, kolīziju risināšana starp valsts un starptautisko tiesību normām ir atkarīga no valsts nostājas – piekrišanas monisma vai duālisma doktrīnai.
Otrā nodaļa ir veltīta ES tiesību būtības analīzei, aplūkojot to tiesību sistēmas jēdziena kontekstā. Autore secina, ka ES tiesību sistēma nevar tikt pilnībā pieskaitīta nedz pie valsts, nedz pie klasisko starptautisko tiesību sistēmas, jo ES tiesības veido patstāvīgu tiesību sistēmu, kurai piemīt savi pamatprincipi, tai skaitā, tās attiecību ar dalībvalstu tiesību sistēmām noteikšanai.
Trešajā nodaļā autore identificē jomas, kurās kolīziju starp ES tiesībām un dalībvalstu tiesībām iespējamība ir vislielākā, kā arī noskaidro līdzekļus šādu kolīziju novēršanai un atrisināšanai, pamatā balstoties uz Tiesas un dalībvalstu konstitucionālo tiesu judikatūras analīzi. The purpose of my doctoral thesis is to examine the nature of EU law and establish the optimal framework for its relationship with the law of the Member States. The purpose is also to identify the areas in which conflicts between the EU law and the law of the Member States are most likely as well as the general principles and techniques for resolving these conflicts.
The thesis consists of three chapters. The first chapter provides an explanation of the concept of conflict of legal rules inter alia in the historical perspective. In the first chapter the author also distinguishes several types of conflicts of legal rules and demonstrates different techniques for their resolution. Regarding the resolution of conflicts within one legal system, the author concludes that both within the domestic and international law the first step of resolution of conflicts is the review of compliance with the basic norms of the legal system. However, when the conflicts arise between domestic and international law, the approach to resolution depends on the position of the State and the acceptance of either the monist or dualist doctrine.
The second chapter deals with the analysis of the conceptual basis of the EU law from the perspective of the concept of the legal system. The author concludes that the EU legal system cannot be fully considered to be either a domestic or a classic international law legal system. EU law forms an autonomous system with its own fundamental principles relating inter alia to the determination of the relationship with the legal systems of the Member States.
In the third chapter the author identifies the areas in which conflicts between the EU law and the law of the Member States are most likely and suggests the general principles and techniques for preventing and resolving these conflicts, primarily on the basis of the case law of the European Court of Justice and the constitutional courts of the Member States.
