Ārvalstu tiesu nolēmumu atzīšana un izpildes atļauja (eksekvatūra) ir viens no
centrālajiem starptautiskā civilprocesa izpētes objektiem. Nepieciešamība atzīt un izpildīt
ārvalstu tiesu nolēmumus pēdējo gadu laikā strauji pieaug. Tas izskaidrojams gan ar Latvijas
kļūšanu par ES dalībvalsti, gan arī ar globalizācijas attīstību pasaulē. Ar 1997.gada 2.oktobra
Amsterdamas līguma1 spēkā stāšanos 1999.gada 1.maijā tieši ES tiesiskās telpas sistēma
kļuva par visstraujāk attīstīto sistēmu ārvalstu tiesu nolēmumu atzīšanas un eksekvatūras
jomā.
Autore savā darbā par galveno mērķi ir izvirzījusi pētīt ārvalstu tiesu nolēmumu
atzīšanas un izpildes atļaujas (eksekvatūras) attīstības tendences ES un Hāgas Starptautisko
privāttiesību konferences (turpmāk – HSPK) ietvaros. Vispārējo tiesību sistēmas izpēte nav šī
darba galvenais uzdevums, taču tajā esošie tiesību institūti apskatīti tikai galvenajos vilcienos.
Autore darbā ir analizējusi attīstības tendenču jautājumu divos galvenajos aspektos:
teorētiskajā (I daļa) un metodoloģiskajā (II daļa) aspektā.
Teorētisko jautājumu izpētes gaitā autore vispirms meklē atbildi uz to, kas ir ārvalsts
tiesas nolēmuma atzīšana un izpildes atļaušana (eksekvatūra). Galvenais uzdevums ir izstrādāt
un noformulēt pēc iespējas skaidrākas šo jēdzienu definīcijas. Tikai šādu definīciju izstrāde
ļauj dziļāk analizēt un izprast arī pārējos ar nolēmumu atzīšanu un eksekvatūru saistītos
teorētiskos jautājumus, piemēram, kādā veidā atzinējvalsts piešķir darbību vai izpildāmību
ārvalsts tiesas nolēmumam?
Metodoloģisko aspektu analīzē autore meklē atbildi uz šādiem galvenajiem
jautājumiem:
1) kādas ir galvenās metodes, ar kuru palīdzību ārvalsts tiesas nolēmumam var piešķirt
darbību (tiesiskās sekas) atzinējvalstī?
2) kāda ir šo metožu attīstības perspektīva un trūkumi ES sistēmā un HSPK sistēmā?
Darba rezultātā ir sniegti priekšlikumi gan ES un starptautisko normatīvo tiesību aktu,
gan Latvijas normatīvo aktu uzlabošanā. Minētā analīze balstās galvenokārt uz ES normatīvā
regulējuma, kā arī HSPK dokumentu izpēti. Tajā pašā laikā autore pētījusi arī citu valstu (jo
īpaši Vācijas un Francijas) normatīvos tiesību aktus, EST un ECT judikatūru, kā arī Latvijas
tiesu pavisam nelielo praksi.
Autore cer, ka šis darbs varētu būt izmantojams šādu zinātnisku un praktisku jautājumu
risināšanai: 1) ES tiesiskajā telpā funkcionējošā tiesu nolēmumu atzīšanas un eksekvatūras
mehānismu juridiskajai izpratnei teorētiskajā un metodoloģiskajā aspektā; 2) Latvijas
Civilprocesa likumā veicamo grozījumu izstrādes zinātniskajam pamatojumam; 3) veiktais
pētījums ļauj prognozēt tuvākajā nākotnē ES un HSPK iespējamās tendences un izmaiņas
tiesu nolēmumu atzīšanas un izpildes jomā; 4) veiktais pētījums Latvijā un ES var noderēt
turpmākajā zinātniski pētnieciskajā darbā saistībā ar ārvalstu tiesu nolēmumu atzīšanas un
izpildes teorētisko un metodoloģisko problēmu tālāko analīzi; 5) visbeidzot, darbu varēs
izmantot arī Latvijas starptautisko privāttiesību nacionālā regulējuma uzlabošanā, vienalga,
vai tas būtu jauns starptautisko privāttiesību likums, vai Civillikuma Ievada pārskatīšana. Recognition and enforcement of foreign judgments in civil and commercial matters is one
of the most important subjects within the framework of the international civil procedure.
During the last years the need to recognise and to enforce foreign judgments has become more
and more urgent. This can be explained both by the accession of Latvia to the European
Union and by the development of the globalisation process in the whole world.
Following the entry into force of Amsterdam Treaty2 (concluded on 2 October 1997, in
force since 1 May 1999), the legal system of the European Union has become by far the most
dynamic and the most developed in this area.
The author has chosen the study of the development tendencies within the European
Union and The Hague Conference on Private International Law as the central and main topic
of her thesis. As examining the Common Law system is not the main goal of the present
study, legal concepts peculiar to this system are covered in a rather general way.
The author has analysed the current tendencies under two aspects: a theoretical aspect
(Part One) and a practical aspect (Part Two).
Concerning the theoretical questions, the author tried to answer the question what
exactly is meant by “recognition” and by “order for enforcement of a foreign judgment” (an
exequatur). Her main goal was to formulate clearer definitions of the key notions in the area
in question. In fact, only after such definitions have been made it becomes possible to analyse
and to understand more in depth other theoretical questions concerning the recognition and
enforcement of foreign judgments, for example: how does the requested State grant legal
force or enforceability to a foreign judgment?
As to the analysis of the methodological aspects, the author tries to answer the following
questions:
(1) What are the methods by which a foreign judgment can be endowed with legal force
or enforceability in the requested State?
(2) What are the perspectives of the development of these methods within the respective
systems of the European Union and The Hague Conference and what lacunae can be detected
in these systems?
The thesis ends in concrete proposals for improvement of European, international and
Latvian legal acts. The analysis developed in the thesis is based on a comparative study of the
normative regulation of the European Union, as well as a draft prepared by The Hague
Conference. The author has also studied legal acts of other States (namely Germany and
France), the case-law of the European Court of Justice and the European Court of Human
Rights, as well as the (regrettably very meagre) case-law of the Latvian courts.
The author hopes that the present thesis could be used as a tool to solve the following
scientific and practical problems:
(1) A better understanding of theoretical and methodological aspects of the mechanisms
for recognition and enforcement that exist and function in the European Union;
(2) A scientific basis for amending the relevant provision of the Latvian Civil Procedure
Act;
(3) A capacity to foresee the tendencies of development in this area in the European
Union and in the system of The Hague Conference;
(4) Still deeper research and analytical study of the area in question both at the domestic
(Latvian) and the European level;
(5) Finally, the thesis could be used in order to improve the Latvian international private
law, either by adopting a new Private International Law Act or by amending the Introductory
Chapter of the Latvian Civil Code.
