Dienesta gaitas Latvijas policijā tiesiskais regulējums

Abstract

Pētījumā „Dienesta gaitas Latvijas policijā tiesiskais regulējums” ir raksturots Latvijā esošais tiesiskais regulējums visiem dienesta gaitas elementiem. Lai atklātu pētījumā izvirzīto mērķi, tika analizēti vairāki aspekti – atlase dienestam, profesionālā sagatavošana, dienesta karjeras organizēšana un dienesta tiesisko attiecību izbeigšana. Minētie aspekti veido pētījuma struktūru, kur katram no tiem veltīta atsevišķa nodaļa. Ņemot vērā ārvalstu pieredzi, ir analizēts dienesta gaitas tiesiskais regulējums Igaunijā, Lietuvā, Polijā, Slovākijā, Bulgārijā u.c. valstīs, kā arī teorētiskie pētījumi Amerikā, Kanādā un Krievijā. Rezultātā ir secināts, ka profesionāls dienests policijā balstās uz piemērotu personu vairāku pakāpju atlasi dienestam un profesionālas dienesta karjeras plānošanu un īstenošanu. Latvijā šie jautājumi ir tikai daļēji tiesiski noregulēti, kas pieļauj neprofesionālu atlases procesu, nesagatavotu amatpersonu pielaišanu dienesta pienākumu pildīšanai. Ir secināts, ka nepastāv dienesta karjeras sistēmas regulējums, līdz ar to šis dienesta gaitas jautājums ir haotisks un gadījuma rakstura. Pētījumā analizēti dienesta gaitas elementi, izvērtējot tiesiskā regulējuma lietderību, norādot uz trūkumiem, nepilnībām un pretrunām, kā arī izstrādāti virzieni problēmu novēršanai. Rezultātā ir konstatēts, ka pārstrādājot tiesisko regulējumu un daļēji izmantojot ārvalstīs praktizēto pieredzi, tiks atlasītas dienestam vispiemērotākās personas, nodrošinot profesionāla dienesta pastāvēšanu, kas virzīts uz katras amatpersonas karjeras attīstību. Tas ļaus policijai pilnvērtīgāk veikt tai noteiktos uzdevumus. The research „The legal regulation of career course in Latvian Police” describes the existing legal regulation of all Service elements. In order to unveil the intended purpose several aspects were analyzed – selection and professional training for the Service, organization of the career and termination of legal relationships. The structure of the research is constituted by the given elements, where a chapter is dedicated to each of them. With regard to foreign experience, the research includes the analysis of the existing legal regulation of Service in Estonia, Lithuania, Poland, Slovakia, Bulgaria etc. as well as theoretical research of the USA, Canadian and Russian legislation. The emerging bottom line is such that professional Service in the Police is based in several-degree selection of candidates apt for Service along with professional planning and pursuing of the career in the Police. In Latvia, there is but partial legal regulation that allows unprofessional selection process and grants admission to official duties to unprepared executives. It has been concluded that there is in effect no legal regulation of Service Career, therefore this issue is of chaotic and coincidental nature. The elements of Service have been analyzed by evaluating the expediency of the judicial regulations, indicating the faults, imperfections and inconsistencies. As the result, the researcher elaborates guidelines for eliminating such problems, which implies revising the current law enforcement as well as partially incorporating foreign best practice, providing selection of the most suitable Service candidates in order to support a professional Service that is aimed at the career development of each individual. Such strategy and the according procedures will allow the duties of the Police to be done properly.
