Civilprocesa teorijā pierādījumu un pierādīšanas jautājums ir viens no pamatinstitūtiem, kurš
atrodas patstāvīgā attīstībā. Civiltiesisko strīdu daudzējādība un sabiedrības prasība ātri un
kvalitatīvi izskatīt ierosināto civillietu tiesā, rada nepieciešamību attīstīt un pilnveidot
civilprocesa pierādīšanas procesu un tā normatīvo regulējumu, kas radītu atbilstošu teorētisko
bāzi un pilnveidotu esošo normatīvo regulējumu.
Attīstoties dažādām tehnoloģijām un ienākot cilvēku ikdienā, kā arī komerciālajā apritē
elektroniskajiem saziņas līdzekļiem, civilprocess nevar palikt konstants attiecībā uz pierādīšanas
līdzekļu izmantošanas regulējumu un pierādījumu pieļaujamību un attiecināmību. Promocijas
darbā ir aplūkotas iespējas pilnveidot pierādīšanas teorijas pamatjautājumus, salīdzinot Latvijas
civilprocesuālo regulējumu ar citu valstu civilprocesiem, analizējot procesuālo regulējumu
atšķirības un dažādos teorētiskos skatījumus.
Civilprocesa principu attīstība izvirza nepieciešamību pārvērtēt sacīkstes principa robežas
kontekstā ar citiem pierādīšanas procesā izmantojamajiem civilprocesa principiem un izvērtēt
iespēju iegūt tiesām lielākas tiesības ietekmēt pierādīšanas procesa virzību, kā arī pierādījumu
iesniegšanas kārtību līdztiesības nodrošināšanas nolūkos starp strīda pusēm.
Promocijas darba mērķis ir pilnveidot civilprocesa pierādījumu un pierādīšanas institūta
teorētisko bāzi, izstrādāt un sniegt priekšlikumus civilprocesa normu pilnveidošanai un
grozīšanai. Darba ietvaros ir salīdzinātas atšķirības starp dažādām civilprocesa doktrīnām,
analizēts jautājums par pierādīšanas nastas īpatnībām un pierādīšanas subjekta tiesībām un
pienākumiem, kā arī izstrādāti priekšlikumi pilnveidot civilprocesa terminoloģiju atbilstoši
civilprocesa attīstības tendencēm. Darba uzdevums ir mazināt formālos šķēršļus civillietu ātrākai
izskatīšanai tiesās pētot ārvalstu regulējuma pozitīvos piemērus. Tiesvedības procesā tiesai ir
jāiegūst nepieciešamās patiesās ziņas un informācija par lietā nozīmīgiem apstākļiem ar
civilprocesa likumā nostiprināto pierādīšanas līdzekļu starpniecību, taču pierādīšanas procesa
gaitā ir nepieciešams izvērtēt lietā iesniegto materiālu atbilstību pierādījuma statusam. Tādējādi
darbā ir sniegti kritēriji pierādījumu atzīšanai un izvērtēšanai, kā arī analizēts jautājums par
puses atbrīvošanu no pierādīšanas pienākuma, vispārzināmiem faktiem, prezumpcijām un sekām
kādas iestājas, ja pierādīšanas procesā civiltiesiskā strīda puse izvēlās pasīvu rīcību.
Promocijas darba rezultāti ir prezentēti autores publikācijās un zinātniskajās konferencēs. Proof and proving in civil procedure theory is one of the principal institutions undergoing
continuous development. The sheer diversity of disputes subject to civil procedure and the
public demand to have civil cases brought before a court resolved quickly and efficiently
result in the necessity to develop and improve the procedure of providing proof in civil
procedure and its regulations with a view to forming a relevant theoretical basis and improving
the existing regulations.
As various technologies are being developed and come into daily life and means of
electronic communication come into commerce, the civil procedure cannot remain invariable as
far as regulations concerning use of the means of proving and the admissibility and applicability
of proof are concerned. This promotion paper looks into the possibility to improve the principal
issues in the theory of proving by comparing Latvian civil procedure law to civil procedures in
other countries and analysing their differences and different perspectives in theory.
Development of the principle of civil procedure brings forward the necessity to reassess
the boundaries of the competition principle in context with other principles of civil procedure
used in the process of proving and to examine the possibility for courts to acquire greater rights
in order to have more weight on the progress of the proving process and the procedure of the
provision of proof in order to ensure equality between the parties to a dispute.
This promotion paper purports to improve the theoretical basis of the institution of civil
procedure proof and proving, to develop and provide proposals for improving and amending
civil procedure law regulations. This paper contains a comparison of the differences among
various civil procedure doctrines, provides an analysis of the peculiarities of the burden of proof
and the rights and obligations of the subject of proof as well as puts forth proposals for the
improvement of civil procedure law terms in line with the tendencies of civil procedure
development. The task of this paper is to reduce formal obstacles to a more speedy review of
civil cases in courts through the study of positive examples in regulations used in foreign
countries. In the course of legal proceedings, a court has to obtain the required true information
about essential circumstances of the case by means of the proof of evidence laid down by the
civil procedure law but in the course of proving the court needs to assess whether materials
provided in the case qualify as proof.
Thus this paper provides criteria for the recognition and assessment of proof and analyses
the issue of releasing a party from the obligation to provide proof, generally known facts,
presumptions and the consequences resulting from a passive attitude in the process of proving by
a party to a civil dispute.
