Promocijas darbā ir analizēts dažādu valstu konstitucionālais regulējums, prakse un tiesību ziātnieku atziņas prezidenta atlaišanas kontekstā, dodot, cita starpā, pilnīgu ieskatu par Latvijas konstitucionālo tiesību attīstību šajā aspektā. Darbā tiek analizēti impičmenta institūta teorētiskie pamati, tā vēsture, būtība, modeļi, kā arī impičmenta tiesisko seku regulējums. Rezultātā tiek konstatēts, ka Valsts prezidenta impičmenta institūta nostiprināšana Satversmē palīdzētu nodrošināt prezidenta amata stabilitāti un izslēgtu iespēju prezidenta nepamatotai atlaišanai bez normativajos aktos noteikta juridiska pamatojuma. Darbā ir piedāvāti konkrēti priekšlikumi Satversmes grozīšanai, lai pilnveidotu Valsts prezidenta atlaišanas kārtību, vienlaikus neizjaucot pastāvošo konstitucionālās sistēmas līdzsvaru. conclusions of legal scholars and legal proceedings as concerns presidential removal.
Thesis analyses the legal nature, the forms and legal consequence of the institution of the
state president’s impeachment
As a result, the author draws the following conclusion: the constitutional consolidation of
the impeachment institution would provide more stability to the state president, as well as
excluding any legally unsubstantiated presidential removal. The thesis provides concrete
proposals for constitutional amendments in Latvia, aiming at improved procedure of
presidential removal. In the mean time, these proposals should not disarrange the existing
constitutional system.
