Cilvēktiesību pamatojums personības koncepcijas perspektīvā

Abstract

Darbs veltīts cilvēktiesību filozofiskajiem pētījumiem, kuri risina jautājumu par to, kas ir cilvēktiesības. Cilvēktiesību loma sabiedriskajā dzīvē ir būtiski pieaugusi, bet ir maza izpratne par šī institūta pamatiem. Autors izmanto personības koncepciju cilvēktiesību filozofiskajā izpētē un cenšas kliedēt cilvēktiesību nenoteiktību no cilvēka individuālās perspektīvas, proti, uzlūko cilvēktiesības kā instrumentus, kuri aizsargā cilvēku kā ētisku būtni un viņa dzīvi. Autors piedāvā cilvēktiesību ētisko interpretāciju. Darbā tiek skaidrots, kāpēc ir nepieciešams cilvēktiesību pamatojums un ko nozīmē tās pamatot, tiek piedāvāts skatījums uz cilvēku, tostarp sasaistot to ar cilvēka cieņas jēdzienu, kā arī risinātas implikācijas, kas izriet no cilvēka izpratnes attiecībā uz cilvēka pozīciju pasaulē un cilvēktiesību satura elementiem.

The work is dedicated to the philosophical studies of human rights and address the question on the essence of human rights. The role of human rights in public life has increased significantly, but there is little understanding of the foundations of these rights. The author uses the personhood account in the philosophical exploration of human rights and seeks to dispel the uncertainty of human rights from the perspective of personhood, i.e. aims to perceive human rights as normative protection of a person as an ethical being and his or her life. The author offers an ethical interpretation of human rights. The work explains why human rights justification is necessary and what it means to justify them, offers a view of the human being linking it to the concept of human dignity, and addresses the implications of understanding of human being towards the human condition in the world and elements of content of human rights.
