A comparative study of MiCA and GDPR: lessons from data protection for regulating crypto-assets in the EU

The EU's regulatory aspirations are once again challenged as it advances into the digital world, however, this time not by personal data but rather by the volatile, rapid changing realm of crypto-assets. This thesis investigates how the lessons of the General Data Protection Regulation (GDPR), a flagship of digital rights, may highlight the road map for the recently conceived Markets in Crypto-Assets Regulation (MiCA). By means of a comparative legal analysis, the paper explores how the accomplishments and challenges of GDPR in harmonisation, enforcement, and consumer confidence provide both inspiration and cautionary stories. It claims that MiCA's success will rely not only on the policies it develops but also on how regularly and wisely they are implemented across the member states. While avoiding GDPR's mistakes, MiCA can create a credible, innovative framework that fosters confidence in Europe's crypto future by taking GDPR's strengths, transparency, accountability, and regulatory consistency.
