Institūciju iejaukšanās un sadarbība bērnu tiesību pārkāpumu gadījumos ģimenē

Abstract

Bērnu tiesību pārkāpumu gadījumos ģimenē ļoti nozīmīga loma iejaukšanās procesā ir pašvaldību institūcijām - sociālā dienestam, policijai, skolām, bāriņtiesas, krīzes centriem – viņu savstarpējā sadarbība, kāda tā ir, ir nozīmīga bērnu tiesību pārkāpumu novēršanai ģimenē un problēmu risināšanā. Autores diplomdarba tēma ir „Institūciju iejaukšanās un sadarbība bērnu tiesību pārkāpumu gadījumos ģimenē”. Diplomdarba mērķis ir izpētīt Rīgas pašvaldības institūciju iejaukšanos un sadarbību bērnu tiesību pārkāpumu gadījumos ģimenē. Lai sasniegtu mērķi, autore noteica šādus galvenos uzdevumus: Noskaidrot biežākos bērnu tiesību pārkāpumus ģimenē un to cēloņus; analizēt bērnu tiesību aizsardzības regulējošo likumdošanu; raksturot galvenās institūcijas bērnu tiesību aizsardzībai ģimenē, to iejaukšanos šādu pārkāpumu gadījumos; raksturot bērnu tiesību aizsardzības institūciju sadarbību, tās kritērijus; noskaidrot pašvaldības institūciju darbinieku viedokli par institūciju iejaukšanos un sadarbību bērnu tiesību pārkāpumu gadījumos; noskaidrot sociālo dienestu klientu viedokli par bērnu tiesību aizsardzības institūciju iejaukšanos un sadarbību bērnu tiesību pārkāpumu gadījumos. Pētnieciskās daļas hipotēze – institūciju sadarbība un iejaukšanās nenotiek pēc komandas darba principiem.

Pētījuma galvenie secinājumi: 1.Sadarbība ietekmē iejaukšanās procesu un pēc tā, kāda ir iejaukšanās var secināt par sadarbību, tās veidu. 2. Ļoti svarīga ir sadarbība komandas darba veidā starp institūciju darbiniekiem, tas efektīvi ietekmē iejaukšanās procesu bērnu tiesību pārkāpumu gadījumos ģimenē. 2.Starp pašvaldību institūciju speciālistiem nenotiek sadarbība pēc komandas darba principiem, bērnu tiesību pārkāpumu gadījumos ģimenē. 3. Trūkst savstarpēji koordinēta kompetences sadalījuma starp pašvaldību institūciju darbiniekiem bērnu tiesību aizsardzībā.

Local authorities, e.g., social service, police, schools, orphan's court, crisis centres, play a vital role in the involvement in the cases of infringements of children's rights within their families. Their mutual cooperation as such is important in preventing infringements of children's rights within their families and in solving the problems. The theme of the present Bachelor's Paper is "Involvement and Cooperation of Authorities in Cases of Infringements of Children's Rights Within Their Families". The aim of the paper is to explore the involvement and cooperation by authorities in the cases of infringements of children's rights in family settings. To achieve this aim the following tasks were defined: To ascertain the most common infringements of children's rights in family and their causes; to analyze the legislation on the protection of children's rights; to characterize the main authorities dealing with the protection of children's rights in family; to enquire what are the views of the officials of the local authorities regarding the involvement and cooperation by the authorities in case infringements of children's rights occur; to find out the opinions of social service customers regarding the involvement and cooperation by the authorities dealing with the protection of children's rights in the cases of infringements of children's rights. Hypothesis of the exploratory part: there is no teamwork in the cooperation and involvement by the local authorities.

Main conclusions of the study: 1. Cooperation affects the process of involvement, and judging by the involvement one can draw conclusions on the cooperation. 2. Teamwork cooperation among the officials of the authorities is very important as it has an effective impact on the process of involvement in the cases of infringements of children's rights within their families. 3. In case of infringements of children's rights within their families professionals of local authorities lack a cooperation that is based on teamwork principles. 4. There is no mutually harmonized division of competences among the officials of local authorities in the field of the protection of children's rights.
