Maģistra darbā „Eiropas Savienības loma Latvijas bioloģiskās daudzveidības veicināšanā” autors pēta, kāda ir Eiropas Savienības loma Latvijas bioloģiskās daudzveidības veicināšanā; kādas ir Latvijas iespējas un vēlmes realizēt savu individuālo politiku bioloģiskās daudzveidības aizsardzības jomā; kā šīs iespējas Latvija izmanto un kādi ir šķēršļi bioloģiskās daudzveidības veicināšanai Latvijā.
Autors veicis Eiropas Savienības un Latvijas normatīvo aktu analīzi, sistematizējis vides zinātņu atziņas, analizējis Eiropas Kopienu tiesas praksi, kā arī veicis Eiropas Savienības un Latvijas mērķu un līdzekļu salīdzinājumu bioloģiskās daudzveidības aizsardzības jomā.
Darbā izvirzītā hipotēze - Latvijas mērķi bioloģiskās daudzveidības aizsardzības jomā aprobežojas ar Eiropas Savienības prasību izpildi – darba gaitā neapstiprinās.
Pētījuma rezultātā autors nonācis pie secinājuma, ka nav pamats uzskatīt, ka Latvijas mērķi bioloģiskās daudzveidības aizsardzības jomā aprobežojas tikai ar Eiropas Savienības prasību izpildi. Latvijā gan pirms iestāšanās Eiropas Savienībā, gan šobrīd tiek veikti bioloģiskās daudzveidības aizsardzības pasākumi, kas neizriet no Eiropas Savienības tiesību normām.
Autors secina, ka Latvijas mērķi bioloģiskās daudzveidības aizsardzības jomā ir pārāk vispārīgi, līdz ar to nav iespējams novērtēt to sasniegšanas pakāpi. Lai to novērstu, autors ierosina noteikt konkrētus, izmērāmus kritērijus, pēc kuriem var noteikt, vai Latvija sasniegusi izvirzītos mērķus. Piemēram, autors ierosina normatīvajos aktos noteikt konkrētu gadu, līdz kuram būtu jāpalielina īpaši aizsargājamo dabas teritoriju platība noteiktā apmērā. Tāpat aicina noteikt, ka līdz noteiktam gadam ar bioloģiskām lauksaimniecības metodēm apstrādātas zemes īpatsvaram jāsasniedz konkrētu apjomu. In the Master’s Thesis “The role of the European Union in Promotion of Biodiversity in Latvia” the author studies the Latvian opportunities and desires to execute its individual policy in the field of protection of biodiversity, how Latvia uses such opportunities and what kinds of obstructions impede encouragement of biodiversity in Latvia.
The author has carried out analysis of statutory regulations of the European Union and Latvia, systemized implications of the environmental science, analyzed case law of the Court of Justice, as well as carried out comparison of objectives and devices of the European Community and Latvia in the field of protection of biodiversity.
The hypothesis set in the Thesis – the Latvian objectives in the field of biodiversity protection are limited to adherence to the requirements of the European Union – has not been confirmed.
As a result of the study the author has come to conclusion that there are no grounds to consider that the Latvian objectives in the field of biodiversity protection are limited only to adherence to the requirements of the European Union. Arrangements on protection of biodiversity were carried out in Latvia before accession to the European Union and also nowadays, which don’t emerge from legislation of the European Union.
The author educes that Latvian objectives in the field of biodiversity protection are too general; therefore it is impossible to assess the level of their attainment. In order to eliminate that the author moves to determine particular, measurable criteria according to which it will be possible to determine whether Latvia has attained the set objectives. For instance, the author proposes to determine in statutory regulations a particular year by which the area of a specially protected territories should be enlarged to a determined extent. Ditto the author moves to determine that by a definite year the proportion of land cultivated applying organic farming methods should attain a particular volume.
