Princips „Pienākums Aizsargāt”: jaunā ANO krīžu pārvaldības pieeja (2001 - 2011) neo-liberālā institucionālisma gaismā

Bakalaura darba „Princips „Pienākums Aizsargāt”: jaunā ANO krīžu pārvaldības pieeja (2001-2011) neo-liberālā institucionālisma gaismā” tēma ir veltīta jaunākai ANO krīžu pārvaldības normatīvai reformai – principam „Pienākums Aizsargāt”. Darba teorētiskās daļas uzdevums ir izpētīt pašu „Pienākumu Aizsargāt” – kas tas ir, tā funkcija un pievienotā vērtība ANO krīžu pārvaldībā. Darba galvenais uzdevums ir izpētīt ANO nozīmi (funkcijas un to lomu) šī principa attīstībā. Darba gaitā tika uzstādīti divi galvenie jautājumi – „Kāda ir ANO loma principa „Pienākums Aizsargāt” attīstībā (radīšanā, nostiprināšanā un institucionālajā ieviešanā)”? un „Cik veiksmīgi ANO pilda savu lomu principa „Pienākums Aizsargāt” attīstībā?”
Tika izvēlēti neo-liberālā institucionālisma trīs efektivitātes kritēriji , kas definēja ANO funkciju jeb lomu „Pienākuma Aizsargāt” (PA) attīstībā. Darba gaitā pierādījās hipotēze, ka „ANO nozīmīga loma principa „Pienākums Aizsargāt” attīstībā ir valdību intereses veicināšanā un dienaskārtības veidošanā, līgumiskās vides veicināšanā un politisko bloku noregulēšanā, kā arī nacionālo un administratīvo kapacitāšu veicināšanā un spēcīgo sabiedroto piesaistē.” Uz jautājumu „Cik veiksmīgi ANO pilda savu lomu principa „Pienākums Aizsargāt” attīstībā?” tika izvirzīta hipotēze, ka „ANO ir veiksmīga dienaskārtības veidošanas procesā, taču mazāk veiksmīga dalībvalstu vienprātības panākšanā caur līgumisku pārrunu vidi, un ir vāja principa ievērošanas nodrošināšanā institucionālajā un nacionālajā līmenī”.
Darba gaitā tika konstatēts, ka ANO ir spēlējusi nozīmīgu lomu PA principa radīšanā un pārveidošanā par starptautisku dienaskārtību, veicinot valstu interesi ar dažādu diplomātisko un normatīvo (informācija) instrumentu palīdzību. ANO ne vienmēr ir spējusi uzturēt līgumisku vidi – lai gan ANO forumi kā pastāvīgas kaulēšanās arēnas ļāva valstīm rast vienotu definīciju 2005. gadā un rast vienotu perspektīvu, kā PA turpmāk operacionalizēt (2009. gadā) Taču joprojām pastāv šaubas un bailes par principa normatīviem un praktiskiem trūkumiem. Tas liecina par to, ka ANO nespēj tik veiksmīgi sekmēt ANO vienprātību uz PA operacionalizāciju. Visvairāk to ietekmē Asamblejā esošie politiskie bloki – opozīcija, atbalsta koalīcija, un pa vidu esošās uzmanīgās valstis, kā arī DP pastāvīgo locekļu intereses, ko tās labprāt aizstāv. Institūcijas efektivitātes trešo kritēriju ANO pilda pašlaik, attīstot globālu PA atbalstītāju tīklu, taču runājot būtiskām PA reformām kā agrīnās brīdināšanas sistēmas uzlabošana un tās attīstība, tad ANO tiek uzskatīta kā vāja šī kritērija izpildē. Tādā veidā var secināt, ka ANO bija veiksmīga dienaskārtības veidošanā , mazāk veiksmīga dalībvalstu vienprātības panākšanā, kā arī ANO ir bijusi vāja dalībvalstu un institūcijas kapacitāšu celšanā, lai pielāgotos jaunajam principam gan normatīvi, gan institucionāli un ar laiku – arī praksē. Autore secina, ka izvirzītās hipotēzes ir pierādītas, un turpmāk pētot ANO lomu kolektīvās drošības jautājumos, uzmanību varētu pievērst ANO lomai principa praktiskajā pielietojumā „on the ground”, izvērtējot to pēc Levija, Hāsa, Keoheina un Joahīmas kritēriju savienojumiem.
Teorētiskās nodaļas secinājumi par PA ir šādi: tas ir universāls princips, taču līdz galam nepaskaidrots un no normatīvas neskaidrības rodas praktiskā rakstura grūtības. Taču galvenā atziņa ir tā, ka princips patiesi var dot ieguldījumu ANO krīžu pārvaldībā , ja izmantot un attīstīt tā preventīvās kapacitātes, kā arī ar principa efektīvu pārvaldību saistītās gan institucionālās, gan arī politiskās reformas, kas līdz šim tika gadiem atliktas. This bachelor thesis namely „The „Responsibility to Protect”: a new approach of UN crisis management (2001 – 2011) in the light of neo-liberal institutionalism” is addressing the issue of Responsibility to Protect - the newest UN normative reform. The main goal of the work is dedicated to evaluate the role of UN in the creation, strenghtening and also institutionally implementing the emerging norm. Another goal of the paper is to explore and analyze what R2P really is, what is it’s function and also added value to the UN crisis management.
Two questions were raised – What is the role of UN in the development of this principle and Is UN successful in its role towards strenghtening and implementing R2P? The author have chosen the neo-liberal institutionalists’ proposals of determing when institutions matter, to use these criteria for the evaluation of UN impact on the development of R2P. Un is important particularly, in raising the interest of states on the matter and articulating agenda-setting process; to promote contractual environment to produce a consensus between states on defining and operationalizing the matter; and in the end to enhance national political and administrative capacities to adjust oneself and a state to new commitments.
United Nations proved to be important in the R2P debate and its development into international agenda – UN was particularly successful in raising state’s interest in R2P by different means (peaceful, diplomacy and etc.) which resulted in R2P becoming internationally recognized in 2005, and also broadly discussed in 2009. On the other hand, consensus seeking by many R2P advocates led to watering down the important innovations proposed with R2P. So we can conclude that political blocks in UNGA and especially in SC can significantly affect the outcome on pushing for reform within UN, which means that UN as an institution is somewhere in the middle of the effect to bring states under one consensus. And the third criteria - a capability to raise national capacities and reform the existing mechanisms to make states to adjust to the new principle, UN proved to be weak. In fact only now some reforms conneced with R2P are deeply discussed and tried to be implemented. From the theoretical part of the work some conclusions about the R2P can be made. R2P is an international principle, not a binding norm, altough its legal sources are binding ones. The principle has inside of it different kinds of norms and some of them are brand new (as pillar II), without any substantive explanations. But the main point of R2P can be seen as a great preventive potential that could bring a substantive changes within UN crisis management. The Report of Ban Ki Moon in 2009 was only the first step in operationalizing and implementing R2P institutionally and also in practice and since many things have to be done more, UN is important in this process of developing R2P further.
