Ministru kabineta pakļautībā vai pārraudzībā neesošo valsts institūciju statuss, to rīcības un pieņemto lēmumu kontrole

Abstract

Maģistra darba tēma ir „Ministru kabineta pakļautībā vai pārraudzībā neesošo valsts institūciju statuss, to rīcības un pieņemto lēmumu kontrole”. Šī tēma ir aktuāla un interesanta, jo ilgāku laiku gan politiķu, gan valsts ierēdņu vidū notiek diskusija par Ministru kabineta padotībā neesošu iestāžu darbības atbilstību Latvijas Republikas Satversmei. Viedokļi šajā jautājumā ir atšķirīgi. Maģistra darbā ir pētītas valsts pārvaldē funkcionējošās patstāvīgās iestādes, to statuss, funkcijas, to darbības kontrole. Pēc patstāvīgo iestāžu darbības un to darbību reglamentējošo normatīvo aktu analīzes ir konstatēts, ka patstāvīgo iestāžu atrašanās ārpus Ministru kabineta pakļautības vai pārraudzības institucionālās sistēmas ir attaisnojama un derīga. Tāpat ir konstatēts, ka atsevišķas patstāvīgās un neatkarīgās valsts pārvaldes iestādes iegūs papildus kapacitāti, ja tās iekļaus Latvijas Republikas Satversmē. Svarīgākais no secinājumiem - patstāvīgo iestāžu darbību nepadara efektīvāku, ja ar likumu tiek noteikta patstāvīgās iestādes pārraudzība no kādas valsts iestādes vai amatpersonas puses. Šinī sakarā ir izvirzīts priekšlikums – nenoteikt pārraudzību patstāvīgajām, neatkarīgām iestādēm, jo galarezultātā tas padara neskaidru šo iestāžu pieņemto lēmumu pārsūdzēšanas kārtību. Maģistra darbu var izmantot politikas zinātnes, socioloģiju un jurisprudenci studējošie. Maģistra darbs var būt arī noderīgs valsts amatpersonām, ierēdņiem un cilvēkiem, kuriem ir interese par valsts pārvaldes jautājumiem.

The theme of this Masters Thesis is “Status of the Government Institutions that are not under the Jurisdiction or Supervision of the Cabinet of Ministers, the Control of their Work and Decision-Making Process.” This topic is current and interesting because it concerns the discussion that has been ongoing among the politicians and civil servants for a while about whether or not the institutions that are not under the jurisdiction of the Cabinet of the Ministers (unaffiliated) conform with the Constitution of the Republic of Latvia (Satversme). The opinions in this case vary. The thesis describes the status, functions and control mechanisms of the unaffiliated state administration organizations. The analysis of the work of the unaffiliated organizations and the normative legal documents concerning their work lead to a conclusion that the placement of the unaffiliated organizations outside the jurisdiction of the Cabinet of Ministers or their institutional system is justifiable and useful. It was also concluded that certain unaffiliated and independent institutions would gain additional capacity if they were included into the Constitution of the Republic of Latvia (Satversme). The main conclusion of the thesis is that the work of the unaffiliated organizations will not be made more efficient if they were by law assigned supervision of a state agency or a state official. Therefore a proposal has been put forth not to assign supervision to unaffiliated, independent organizations, because it could lead to obscuring the appealing process against the decisions of these organizations. This Masters thesis can be used by the students of political science, sociology and law. This Masters thesis can also be useful to the state officials, civil servants and individuals with an interest in the issues of public administration.
