dc.description.abstract | Latvijas tiesiskās sistēmas tiesību piemērotāju un zinātnieku paustajos viedokļos ir novērojama dabisko tiesību doktrīnas dominance, kas pēc Latvijas Republikas neatkarības atjaunošanas ir izskaidrojama ar pastiprināti negatīvu attieksmi pret tiesību pozitīvismu. Latvijā tiesību pozitīvisms tiek atspoguļots ar klasiskajam, 19. gadsimta tiesību pozitīvismam raksturīgajām īpašībām.
Autora mērķis ir atspēkot Latvijā pret tiesību pozitīvismu vērsto negatīvo kritiku un pierādīt tiesību pozitīvisma, kā deskriptīvas teorijas par tiesību esību, nozīmīgumu. Šis pētījums atspoguļo tiesību pozitīvisma ģenēzi, kā arī tā attīstību līdz mūsdienām, izvērtējot jaunāko doktrīnas tēžu atbilstību mūsdienīgas, kontinentālās Eiropas tiesību lokam piederošas valsts tiesiskajai sistēmai. Pētījuma ietvaros autors pierāda, ka mūsdienu tiesību pozitīvisma doktrīnas pārstāvju atziņas nav pretrunā Latvijas tiesiskās sistēmas pamatā esošajam demokrātiskas tiesiskas valsts principam.

dc.description.abstract | Dominance of the natural law doctrine can be observed among the legal practitioners and scientists, which, after the restoration of the independence of Republic of Latvia, can be explained with the particularly negative attitude towards the legal positivism. In Latvia legal positivism is characterized with the qualities inherent to the classical legal positivism of the 19th century.
The goal of the author is to rebut the negative criticism directed towards the legal positivism in Latvia and to prove the importance of legal positivism as a descriptive theory about the existence of law. This research reflects the genesis as well as the evolution of legal positivism by evaluating the compliance of the recent thesis provided by the doctrine with the principles of a legal system adherent to the law of Continental Europe. Author demonstrates that the concepts provided by modern legal positivism are not contradicted to the principle of democratic, law-governed state which is fundamental for the Latvian legal system.
